ถ้าข้อกำหนดพินัยกรรมมีเงื่อนไข และเงื่อนไขนั้นสำเร็จเสียก่อนเวลาที่ผู้ทำพินัยกรรมตาย หากว่าเป็นเงื่อนไขบังคับก่อน ข้อกำหนดพินัยกรรมนั้นมีผลเมื่อผู้ทำพินัยกรรมตาย หากว่าเป็นเงื่อนไขบังคับหลัง ข้อกำหนดพินัยกรรมนั้นเป็นอันไร้ผลถ้าเงื่อนไขบังคับก่อนสำเร็จภายหลังที่ผู้ทำพินัยกรรมตาย ข้อกำหนดพินัยกรรมมีผลตั้งแต่เวลาเงื่อนไขสำเร็จถ้าเงื่อนไขบังคับหลังสำเร็จภายหลังที่ผู้ทำพินัยกรรมตาย ข้อกำหนดพินัยกรรมมีผลตั้งแต่เวลาที่ผู้ทำพินัยกรรมตาย แต่ตกเป็นอันไร้ผลในเมื่อเงื่อนไขนั้นสำเร็จแต่ถ้าผู้ทำพินัยกรรมได้กำหนดไว้ในพินัยกรรมว่า ในกรณีที่กล่าวมาในสองวรรคก่อนนั้น ให้ความสำเร็จแห่งเงื่อนไขมีผลย้อนหลังไปถึงเวลาที่ผู้ทำพินัยกรรมตาย ก็ให้เป็นไปตามเจตนาของผู้ทำพินัยกรรมนั้น

English translation
If a testamentary disposition is subject to a condition and the condition has been fulfilled before the death of the testator; if the condition is precedent, such disposition takes effect at the death of the testator; if the condition is subsequent, the disposition has no effect. If the condition precedent is fulfilled after the death of the testator, the testamentary disposition takes effect from the time the condition is fulfilled. If the condition subsequent is fulfilled after the death of the testator, the testamentary disposition takes effect at the death of the testator but ceases to have effect when the condition is fulfilled. However, if the testator has declared in the will that, in the case provided by the two foregoing paragraphs the effect of the fulfillment of the condition shall relate back to the time of his death, such declaration of intention shall prevail.
