บุคคลใดมีกายพิการหรือมีจิตฟั่นเฟือนไม่สมประกอบ หรือประพฤติสุรุ่ยสุร่ายเสเพลเป็นอาจิณ หรือติดสุรายาเมา หรือมีเหตุอื่นใดทำนองเดียวกันนั้น จนไม่สามารถจะจัดทำการงานโดยตนเองได้ หรือจัดกิจการไปในทางที่อาจจะเสื่อมเสียแก่ทรัพย์สินของตนเองหรือครอบครัว เมื่อบุคคลตามที่ระบุไว้ในมาตรา ๒๘ ร้องขอต่อศาล ศาลจะสั่งให้บุคคลนั้นเป็นคนเสมือนไร้ความสามารถก็ได้ บุคคลซึ่งศาลได้สั่งให้เป็นคนเสมือนไร้ความสามารถตามวรรคหนึ่ง ต้องจัดให้อยู่ในความพิทักษ์ การแต่งตั้งผู้พิทักษ์ ให้เป็นไปตามบทบัญญัติบรรพ ๕ แห่งประมวลกฎหมายนี้ ให้นำบทบัญญัติว่าด้วยการสิ้นสุดของความเป็นผู้ปกครองในบรรพ ๕ แห่งประมวลกฎหมายนี้ มาใช้บังคับแก่การสิ้นสุดของการเป็นผู้พิทักษ์โดยอนุโลม คำสั่งของศาลตามมาตรานี้ ให้ประกาศในราชกิจจานุเบกษา

Une personne atteinte d'une infirmité physique ou mentale, d'une prodigalité ou d'une intoxication habituelles, ou pour toute autre raison similaire la rendant incapable de gérer ses affaires, ou dont la gestion est susceptible de porter préjudice à ses biens ou à sa famille, peut être déclarée quasi-incapable par le tribunal, sur requête de l'une des personnes visées à l'article 28. La personne déclarée quasi-incapable en vertu du premier paragraphe doit être placée sous curatelle. La nomination du curateur est effectuée conformément aux dispositions du livre V du Code. L'ordonnance du tribunal rendue en application du présent article est publiée au Journal officiel.
