ถ้าทรัพย์สินซึ่งให้เช่าสูญหายไปแต่เพียงบางส่วน และมิได้เป็นเพราะความผิดของผู้เช่า ท่านว่าผู้เช่าจะเรียกให้ลดค่าเช่าลงตามส่วนที่สูญหายก็ได้ในกรณีเช่นนี้ ถ้าผู้เช่าไม่สามารถใช้สอยทรัพย์สินส่วนที่ยังคงเหลืออยู่นั้นสำเร็จประโยชน์ได้ดังที่ได้มุ่งหมายเข้าทำสัญญาเช่าไซร้ ท่านว่าผู้เช่าจะบอกเลิกสัญญาเสียก็ได้

English translation
If part only of the property hired is lost without the fault of the hirer, he may claim that the rent be reduced in portion to the part lost. If in such case the hirer cannot with the remaining part accomplish the purpose for which he entered the contract of hire, he may terminate.
