Si la qualification personnelle de l'entrepreneur est une condition essentielle du contrat et que celui-ci décède ou devient, sans faute de sa part, incapable de poursuivre les travaux, le contrat prend fin. Si une partie quelconque des travaux déjà effectués est utile au maître d'ouvrage, celui-ci est tenu de l'accepter et de verser une rémunération raisonnable.
