ถ้าจำนองทรัพย์สินหลายสิ่งเพื่อประกันหนี้แต่รายหนึ่งรายเดียวและมิได้ระบุลำดับไว้ไซร้ ท่านว่าผู้รับจำนองจะใช้สิทธิของตนบังคับแก่ทรัพย์สินนั้น ๆ ทั้งหมด หรือแต่เพียงบางสิ่งก็ได้ แต่ท่านห้ามมิให้ทำเช่นนั้นแก่ทรัพย์สินมากสิ่งกว่าที่จำเป็นเพื่อใช้หนี้ตามสิทธิแห่งตน ถ้าผู้รับจำนองใช้สิทธิของตนบังคับแก่ทรัพย์สินทั้งหมดพร้อมกัน ท่านให้แบ่งภาระแห่งหนี้นั้นกระจายไปตามส่วนราคาแห่งทรัพย์สินนั้น ๆ เว้นแต่ในกรณีที่ได้ระบุจำนวนเงินจำนองไว้เฉพาะทรัพย์สินแต่ละสิ่ง ๆ เป็นจำนวนเท่าใด ท่านให้แบ่งกระจายไปตามจำนวนเงินจำนองที่ระบุไว้เฉพาะทรัพย์สิ่งนั้น ๆ แต่ถ้าผู้รับจำนองใช้สิทธิของตนบังคับแก่ทรัพย์สินอันใดอันหนึ่งแต่เพียงสิ่งเดียวไซร้ ผู้รับจำนองจะให้ชำระหนี้อันเป็นส่วนของตนทั้งหมดจากทรัพย์สินอันนั้นก็ได้ ในกรณีเช่นนั้น ท่านให้ถือว่าผู้รับจำนองคนถัดไปโดยลำดับย่อมเข้ารับช่วงสิทธิของผู้รับจำนองคนก่อนและจะเข้าบังคับจำนองแทนที่คนก่อนก็ได้แต่เพียงเท่าจำนวนซึ่งผู้รับจำนองคนก่อนจะพึงได้รับจากทรัพย์สินอื่น ๆ ตามบทบัญญัติดังกล่าวมาในวรรคก่อนนั้น

English translation
When several properties have been mortgaged to secure one and the same obligation and no order has been specified, the mortgagee may enforce his right against all or any of the properties; provided that he does not do so upon more properties than is necessary for the satisfaction of his right. If the mortgagee enforces his right against all properties at the same time, the burden of the obligation is divided according to the respective value of the properties, except where the amounts of the mortgages have been specified for each property, in which case the division is made according to the respective amounts of the mortgages on such properties. If, however, the mortgagee enforces his right against one of the properties, the mortgagee may receive performance of his entire obligation from such property. In that case the mortgagee who is next in rank shall be considered as being subrogated to the prior mortgagee and may enforce the mortgage in his stead to the amount which the prior mortgagee would have received from the other properties according to the provisions of the foregoing paragraph.
