ถ้าจำนองทรัพย์สินหลายสิ่งเพื่อประกันหนี้แต่รายหนึ่งรายเดียวและมิได้ระบุลำดับไว้ไซร้ ท่านว่าผู้รับจำนองจะใช้สิทธิของตนบังคับแก่ทรัพย์สินนั้น ๆ ทั้งหมด หรือแต่เพียงบางสิ่งก็ได้ แต่ท่านห้ามมิให้ทำเช่นนั้นแก่ทรัพย์สินมากสิ่งกว่าที่จำเป็นเพื่อใช้หนี้ตามสิทธิแห่งตน ถ้าผู้รับจำนองใช้สิทธิของตนบังคับแก่ทรัพย์สินทั้งหมดพร้อมกัน ท่านให้แบ่งภาระแห่งหนี้นั้นกระจายไปตามส่วนราคาแห่งทรัพย์สินนั้น ๆ เว้นแต่ในกรณีที่ได้ระบุจำนวนเงินจำนองไว้เฉพาะทรัพย์สินแต่ละสิ่ง ๆ เป็นจำนวนเท่าใด ท่านให้แบ่งกระจายไปตามจำนวนเงินจำนองที่ระบุไว้เฉพาะทรัพย์สิ่งนั้น ๆ แต่ถ้าผู้รับจำนองใช้สิทธิของตนบังคับแก่ทรัพย์สินอันใดอันหนึ่งแต่เพียงสิ่งเดียวไซร้ ผู้รับจำนองจะให้ชำระหนี้อันเป็นส่วนของตนทั้งหมดจากทรัพย์สินอันนั้นก็ได้ ในกรณีเช่นนั้น ท่านให้ถือว่าผู้รับจำนองคนถัดไปโดยลำดับย่อมเข้ารับช่วงสิทธิของผู้รับจำนองคนก่อนและจะเข้าบังคับจำนองแทนที่คนก่อนก็ได้แต่เพียงเท่าจำนวนซึ่งผู้รับจำนองคนก่อนจะพึงได้รับจากทรัพย์สินอื่น ๆ ตามบทบัญญัติดังกล่าวมาในวรรคก่อนนั้น

Lorsque plusieurs biens sont hypothéqués pour garantir une même obligation et qu'aucun ordre n'a été spécifié, le créancier hypothécaire peut faire valoir son droit sur l'ensemble ou une partie de ces biens, à condition de ne pas le faire sur un nombre de biens supérieur à celui nécessaire à l'exécution de son droit. Si le créancier hypothécaire fait valoir son droit sur tous les biens simultanément, la charge de l'obligation est répartie en fonction de la valeur respective des biens, sauf si les montants des hypothèques ont été spécifiés pour chaque bien, auquel cas la répartition se fait en fonction des montants respectifs des hypothèques grevant ces biens. Si, toutefois, le créancier hypothécaire fait valoir son droit sur l'un des biens, il peut obtenir l'exécution intégrale de son obligation à partir de ce bien. Dans ce cas, le créancier hypothécaire de rang suivant est subrogé au créancier hypothécaire de premier rang et peut faire exécuter l'hypothèque à sa place pour le montant que le créancier hypothécaire de premier rang aurait obtenu des autres biens conformément aux dispositions du paragraphe précédent.
