เมื่อผู้รับจำนองคนใดจะบังคับจำนองเอาแก่ผู้รับโอนทรัพย์สินซึ่งจำนอง ผู้รับจำนองต้องมีจดหมายบอกกล่าวแก่ผู้รับโอนล่วงหน้าเป็นระยะเวลาไม่น้อยกว่าหกสิบวันก่อน จึงจะบังคับจำนองได้
