อันจำนำย่อมระงับสิ้นไป(๑) เมื่อหนี้ซึ่งจำนำเป็นประกันอยู่นั้นระงับสิ้นไปเพราะเหตุประการอื่นมิใช่เพราะอายุความ หรือ(๒) เมื่อผู้รับจำนำยอมให้ทรัพย์สินจำนำกลับคืนไปสู่ครอบครองของผู้จำนำ
