Si l'autre partie à la transaction ne remplit pas ses obligations, le commissionnaire n'est pas responsable envers le mandant de leur exécution, sauf si le contrat le prévoit, si cela peut être implicitement déduit des relations d'affaires entre le mandant et le commissionnaire, ou encore des usages locaux. Le commissionnaire qui s'engage à garantir l'exécution d'un contrat selon les conditions mentionnées au paragraphe précédent est un agent de confiance et a droit à une rémunération spécifique.
