ถ้าผู้รับประกันภัยได้รู้ข้อความจริงดังกล่าวในมาตรา ๘๖๕ นั้นก็ดีหรือรู้ว่าข้อแถลงความเป็นความเท็จก็ดี หรือควรจะได้รู้เช่นนั้นหากใช้ความระมัดระวังดังจะพึงคาดหมายได้แต่วิญญูชนก็ดี ท่านให้ฟังว่าสัญญานั้นเป็นอันสมบูรณ์
