การที่ตั๋วแลกเงินขาดรับรองหรือขาดใช้เงินนั้น ต้องทำให้เป็นหลักฐานตามแบบระเบียบด้วยเอกสารฉบับหนึ่ง เรียกว่าคำคัดค้าน คำคัดค้านการไม่ใช้เงินต้องทำในวันซึ่งจะพึงใช้เงินตามตั๋วนั้น หรือวันใดวันหนึ่งภายในสามวันต่อแต่นั้นไป คำคัดค้านการไม่รับรองต้องทำภายในจำกัดเวลาซึ่งกำหนดไว้เพื่อการยื่นตั๋วเงินให้เขารับรอง หรือภายในสามวันต่อแต่นั้นไป เมื่อมีคำคัดค้านการไม่รับรองขึ้นแล้วก็เป็นอันไม่ต้องยื่นเพื่อให้ใช้เงิน และไม่ต้องทำคำคัดค้านการไม่ใช้เงิน ในกรณีทั้งหลายซึ่งกล่าวไว้ในมาตรา ๙๕๙ (ข) (๒) นั้น ท่านว่าผู้ทรงยังหาอาจจะใช้สิทธิไล่เบี้ยได้ไม่ จนกว่าจะได้ยื่นตั๋วเงินให้ผู้จ่ายใช้เงิน และได้ทำคำคัดค้านขึ้นแล้ว ในกรณีทั้งหลายดังกล่าวไว้ในมาตรา ๙๕๙ (ข) (๓) นั้น ท่านว่าถ้าเอาคำพิพากษาซึ่งสั่งให้ผู้สั่งจ่ายเป็นคนล้มละลายออกแสดง ก็เป็นการเพียงพอที่จะทำให้ผู้ทรงสามารถใช้สิทธิไล่เบี้ยได้

English translation
Non-acceptance or non-payment of a bill of exchange must be evidenced in due form by a document called a protest. A protest for non-payment must be made on the day the bill is payable or on one of the three following days. A protest for non-acceptance must be made within the period fixed for presentment for acceptance or within the three following days. Where a protest for non-acceptance has been made, presentment for payment and protest for non-payment are unnecessary. In the cases mentioned in Section 959(b)(2), the holder may not exercise his right of recourse until the bill has been presented to the drawee for payment and a protest has been made. In the cases mentioned in Section 959(b)(3), production of the judgment adjudging the drawer bankrupt is sufficient to enable the holder to exercise his right of recourse.
