ธนาคารจำต้องใช้เงินตามเช็คซึ่งผู้เคยค้ากับธนาคารได้ออกเบิกเงินแก่ตน เว้นแต่ในกรณีดังกล่าวต่อไปนี้ คือ(๑) ไม่มีเงินในบัญชีของผู้เคยค้าคนนั้นเป็นเจ้าหนี้พอจะจ่ายตามเช็คนั้น หรือ(๒) เช็คนั้นยื่นเพื่อให้ใช้เงินเมื่อพ้นเวลาหกเดือนนับแต่วันออกเช็ค หรือ(๓) ได้มีคำบอกกล่าวว่าเช็คนั้นหายหรือถูกลักไป

English translation
A bank must pay a cheque drawn on it by a customer, except in the following cases: (1) there are not sufficient funds standing to the credit of that customer's account to pay the cheque; (2) the cheque is presented for payment more than six months after its date of issue; (3) notice has been given that the cheque has been lost or stolen.
