Annotation de l'entreprise
Section 282 gives the executing officer a search power over premises the judgment debtor possesses, within Book 4, Title 2, Part 6. It is triggered by reasonable grounds to believe the debtor's property, accounts, documents, letters, or other related objects are located there, whether the debtor possesses the place alone or with others. The power is broad in scope: the officer may search, inspect, and seize records and objects relating to the debtor's property or affairs for examination, and may take necessary steps to gain entry, including opening safes, cabinets, and other storage. It complements Section 277 on examining the debtor about assets and Section 283, which requires a court-issued search warrant when the target premises are possessed by a third party rather than the debtor.
Pourquoi cela est important en pratique
This is a strong power, but it is confined to premises the judgment debtor actually possesses, alone or jointly. If the officer needs to search a place held by a third party, Section 282 does not apply and a court-issued search warrant under Section 283 is required instead, so the possession status of the premises matters. Debtors should understand that the officer can open safes and cabinets and take documents about their assets and affairs for examination. Where records that reveal assets are being kept out of reach, this power is often the key to effective debt recovery.
Foire aux questions
Can the executing officer search the debtor's premises?
Yes. Under Section 282, where there are reasonable grounds to believe the debtor's property or related records are in a place the debtor possesses, the officer may search it, inspect and seize documents and objects, and open safes, cabinets, or other storage.
What if the property is in a place held by someone other than the debtor?
Section 282 covers only premises the debtor possesses. Where the place is possessed by a third party, the officer cannot rely on this section and a court-issued search warrant under Section 283 is required instead.
