Article 312: Seizing immovable property

การยึดอสังหาริมทรัพย์ของลูกหนี้ตามคำพิพากษานั้น ให้เจ้าพนักงานบังคับคดีกระทำโดย
(๑) นำหนังสือสำคัญสำหรับทรัพย์นั้นมาเก็บรักษาไว้ หรือฝากไว้แก่บุคคลใดตามที่เห็นสมควร เว้นแต่ทรัพย์นั้นยังไม่มีหนังสือสำคัญหรือนำหนังสือสำคัญมาไม่ได้
(๒) แสดงให้เห็นประจักษ์แจ้งโดยการปิดประกาศไว้ที่ทรัพย์นั้นว่า ได้มีการยึดทรัพย์นั้นแล้ว
(๓)
แจ้งรายการทรัพย์ที่ยึดให้บุคคลดังต่อไปนี้ทราบ
(ก) ลูกหนี้ตามคำพิพากษา
(ข)
บุคคลอื่นซึ่งมีชื่อในทะเบียนว่าเป็นเจ้าของทรัพย์นั้น(ค)
เจ้าพนักงานที่ดินหรือพนักงานเจ้าหน้าที่ผู้มีอำนาจหน้าที่จดทะเบียนสิทธิและนิติกรรมเกี่ยวกับทรัพย์นั้น
ถ้าทรัพย์นั้นมีทะเบียน
ให้เจ้าพนักงานที่ดินหรือพนักงานเจ้าหน้าที่บันทึกการยึดไว้ในทะเบียนในกรณีที่ไม่สามารถแจ้งตามวรรคหนึ่ง
(๓) (ก) หรือ (ข) ได้ ให้ปิดประกาศแจ้งรายการทรัพย์ที่ยึดไว้ในที่แลเห็นได้ง่าย ณ ภูมิลำเนาหรือสำนักทำการงานของบุคคลเช่นว่านั้น หรือแจ้งโดยวิธีอื่นใดตามที่เจ้าพนักงานบังคับคดีเห็นสมควร และให้มีผลใช้ได้นับแต่เวลาที่ประกาศนั้นได้ปิดไว้หรือการแจ้งโดยวิธีอื่นใดตามที่เจ้าพนักงานบังคับคดีเห็นสมควรนั้นได้ทำหรือได้ตั้งต้นแล้วเมื่อได้แจ้งการยึดให้ลูกหนี้ตามคำพิพากษาและเจ้าพนักงานที่ดินหรือพนักงานเจ้าหน้าที่ผู้มีอำนาจหน้าที่จดทะเบียนสิทธิและนิติกรรมเกี่ยวกับทรัพย์นั้นแล้ว ให้ถือว่าเป็นการยึดตามกฎหมาย
English translation
The seizure of immovable property of the judgment debtor shall be carried out by the executing officer by:
(1) taking the title document for that property into safekeeping, or depositing it with any person as the officer sees fit, except where that property has no title document or the title document cannot be produced;
(2) making it clearly apparent, by posting a notice at the property, that the property has been seized;
(3) giving notice of the list of seized property to the following persons:
(a) the judgment debtor;
(b) any other person whose name appears in the register as owner of that property;
(c) the land officer or the competent official empowered to register rights and juristic acts concerning that property; if the property has a register, the land officer or competent official shall record the seizure in the register.
Where notice cannot be given under paragraph one (3)(a) or (b), a notice of the list of seized property shall be posted in a conspicuous place at the domicile or office of such person, or notice shall be given by any other means as the executing officer sees fit, and it takes effect from the time the notice is posted, or the notice by such other means is made or begun.
Once notice of the seizure has been given to the judgment debtor and to the land officer or the competent official empowered to register rights and juristic acts concerning that property, it shall be deemed a seizure according to law.

This section, in Part 3, prescribes the mechanics for seizing immovable property such as land and buildings, the most common target of execution. The steps are custody of the title document, a visible posted notice on the property, and notice to the debtor, any registered owner, and the land office, which records the seizure. A posting fallback applies where the debtor or registered owner cannot be served. The final paragraph fixes the point of completion: the seizure is effective in law once the debtor and the land officer have been notified. Older decisions citing Section 312 often concern the pre-2017 numbering on attachment and garnishee liability, so read them against the current text.
Why this matters in practice
A land seizure only bites when each step is done, especially posting the notice on the property and recording it at the land office, and the Supreme Court will scrutinise proof of when and where the notice was posted. Creditors should keep evidence of every step; anyone buying land should check the register for a recorded seizure before completing. A defect in posting or notice can lead to the seizure being set aside.

A valid seizure of land under Section 312(2) requires that the executing officer make the seizure clearly apparent by posting a notice at the property; if there is no evidence of when and where the notice was posted, and no report of the posting to the court, the land cannot be held to have been validly seized.
The executing officer produced no witness or report showing when and where the seizure notice was posted on the disputed land. The Court held it could not be found that the land had been seized as required by Section 312(2).

Comment se déroule une saisie foncière lors d'une exécution en Thaïlande ?
Conformément à l'article 312, l'huissier de justice se procure le titre de propriété, affiche un avis de saisie sur le bien et notifie le débiteur, tout propriétaire inscrit, ainsi que le bureau du cadastre, qui enregistre la saisie. La saisie est effective dès que le débiteur et le bureau du cadastre ont été informés.
Quand une saisie foncière est-elle juridiquement valable ?
En vertu du dernier paragraphe de l'article 312, la saisie est considérée comme une saisie légale une fois qu'un avis a été donné à la fois au débiteur du jugement et à l'agent foncier habilité à enregistrer les droits sur la propriété.
Que se passe-t-il si l'avis de saisie n'a pas été correctement affiché sur la propriété ?
L’agent chargé de l’exécution doit pouvoir prouver la date et le lieu d’affichage de l’avis. À défaut, le tribunal peut conclure que la saisie des biens n’était pas valide en vertu de l’article 312(2).
