Article 311: Seizing licenses and concessions

การยึดสิทธิของลูกหนี้ตามคำพิพากษาตามใบอนุญาต ประทานบัตร อาชญาบัตร สัมปทาน หรือสิทธิอย่างอื่นของลูกหนี้ตามคำพิพากษาที่มีลักษณะคล้ายคลึงกันหรือที่เกี่ยวเนื่องกันกับสิทธิดังกล่าว ให้เจ้าพนักงานบังคับคดีกระทำโดย
(๑) แจ้งรายการสิทธิที่ยึดให้ลูกหนี้ตามคำพิพากษาทราบ ถ้าไม่สามารถกระทำได้ ให้ดำเนินการตามวิธีการที่บัญญัติไว้ในมาตรา ๓๐๕ วรรคสอง
(๒) แจ้งให้นายทะเบียนหรือพนักงานเจ้าหน้าที่ผู้มีอำนาจหน้าที่ตามกฎหมายว่าด้วยการนั้นบันทึกการยึดไว้ในทะเบียน
English translation
The seizure of a right of the judgment debtor under a license, a mining lease, a prospecting license, a concession, or any other right of the judgment debtor of a similar nature or connected with such rights, shall be carried out by the executing officer by:
(1) giving notice of the list of the seized rights to the judgment debtor; if this cannot be done, proceeding in accordance with the method provided in Section 305, paragraph two;
(2) giving notice to the registrar or the competent official empowered under the law governing that matter to record the seizure in the register.

This section, in Part 3, brings statutory permits and concessions, such as mining leases and prospecting licenses, within the reach of execution as valuable transferable rights. The method mirrors the other special-rights provisions: notice to the debtor, a fallback to the Section 305 posting method, and a register entry by the competent authority. Older Supreme Court decisions citing Section 311 usually concern the pre-2017 numbering on attachment of claims and service of attachment orders, so read them against the current text.
Why this matters in practice
Where a debtor's value lies in a concession or license, it may be seizable, but the terms of the permit and any transfer restrictions imposed by the granting authority will shape what can actually be realised. Creditors should serve the debtor and secure a register entry with the competent authority; the authority's consent rules may govern any onward transfer. Assess transferability before pursuing this route.

Une concession ou un permis minier peut-il faire l'objet d'une saisie-exécution ?
Oui. En vertu de l'article 311, les droits découlant d'une licence, d'un bail minier, d'une licence de prospection ou d'une concession peuvent être saisis en notifiant le débiteur et en faisant enregistrer la saisie dans le registre par le registraire ou le fonctionnaire compétent.
La saisie d'une concession signifie-t-elle qu'elle peut être librement vendue ?
