ผู้ใดเป็นเจ้าพนักงาน มีตำแหน่งหน้าที่ควบคุมดูแลผู้ที่ต้องคุมขังตามอำนาจของศาล ของพนักงานสอบสวน หรือของเจ้าพนักงานผู้มีอำนาจสืบสวนคดีอาญา กระทำด้วยประการใด ๆ ให้ผู้ที่อยู่ในระหว่างคุมขังนั้นหลุดพ้นจากการคุมขังไป ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงเจ็ดปี และปรับตั้งแต่สองหมื่นบาทถึงหนึ่งแสนสี่หมื่นบาท ถ้าผู้ที่หลุดพ้นจากการคุมขังไปนั้นเป็นบุคคลที่ต้องคำพิพากษาของศาลหนึ่งศาลใดให้ลงโทษประหารชีวิต จำคุกตลอดชีวิตหรือจำคุกตั้งแต่สิบห้าปีขึ้นไป หรือมีจำนวนตั้งแต่สามคนขึ้นไป ผู้กระทำต้องระวางโทษจำคุกตั้งแต่สองปีถึงสิบปี และปรับตั้งแต่สี่หมื่นบาทถึงสองแสนบาท หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]
English translation
Whoever, being an official having the position or duty of guarding a person held in custody under the authority of the court, of an inquiry official, or of an official having the power to investigate criminal cases, does anything to cause the person held in custody to escape from custody, shall be liable to imprisonment from one year to seven years and a fine from twenty thousand baht to one hundred and forty thousand baht.
If the person who escapes from custody is a person sentenced by any court to death, to imprisonment for life, or to imprisonment of fifteen years or more, or if the persons who escape number three or more, the offender shall be liable to imprisonment from two years to ten years and a fine from forty thousand baht to two hundred thousand baht.

Section 204 sits in the chapter on malfeasance in judicial office and punishes the guard who lets the prisoner go. Its elements are (1) being an official whose position or duty is to guard a person held in custody, (2) that custody being under the authority of a court, of an inquiry official, or of an official with the power to investigate criminal cases, and (3) doing anything that causes the person in custody to escape. The conduct is deliberate: Section 205 is the separate and much lighter offence where the same result is brought about by negligence. Paragraph two raises the penalty by reference to who escaped and how many, to two to ten years and a fine from 40,000 to 200,000 baht, where the escaper was under sentence of death, of imprisonment for life, or of fifteen years or more, or where three or more escape. The offence is complete on the escape and requires no dishonest motive, which is what distinguishes it from the general malfeasance offence in Section 157.
Why this matters in practice
The first question is always which paragraph applies, because the aggravated tier carries a two year minimum and turns on facts outside the officer's own conduct: the sentence the escaper was serving, or the number who got away. The second is whether the accused actually held the guarding duty, since the section reaches only an official whose position or duty is to guard a person in custody, not every officer who happened to be present. Where the escape resulted from carelessness rather than a deliberate act, the charge belongs under Section 205 and the difference in exposure is very large. The offence is committed against the State in an official capacity and cannot be settled privately.
