ผู้ใดตระเตรียมเพื่อกระทำความผิดดังกล่าวในมาตรา ๒๑๗ หรือมาตรา ๒๑๘ ต้องระวางโทษเช่นเดียวกับพยายามกระทำความผิดนั้น ๆ

มาตรา 219 อยู่ในหมวดความผิดเกี่ยวกับการก่อให้เกิดภยันตรายต่อประชาชน มีลักษณะเป็นบทเพิ่มโทษมิใช่ฐานความผิดใหม่โดยลำพัง ใช้เมื่อการกระทำพื้นฐานเป็นการวางเพลิงเผาทรัพย์ของผู้อื่นตามมาตรา 217 และไฟนั้นเป็นเหตุให้เกิดอันตรายแก่ชีวิตของบุคคลใด ผู้กระทำจึงต้องรับโทษในอัตราเดียวกับการวางเพลิงที่มีโทษหนักตามมาตรา 218 โจทก์ต้องนำสืบทั้งการวางเพลิงตามมาตรา 217 ที่สำเร็จ และผลที่ก่อให้เกิดอันตรายแก่ชีวิตบุคคลอย่างแท้จริง มาตรานี้จึงเป็นตัวเชื่อมระหว่างการวางเพลิงธรรมดาตามมาตรา 217 กับโทษหนักตามมาตรา 218
