ทรัพย์สินอันได้มาโดยการกระทำผิดนั้น ท่านว่าผู้กระทำผิดหรือผู้รับโอนไม่สุจริตจะได้กรรมสิทธิ์โดยอายุความก็แต่เมื่อพ้นกำหนดอายุความอาชญา หรือพ้นเวลาที่กำหนดไว้ในมาตราก่อน ถ้ากำหนดไหนยาวกว่า ท่านให้ใช้กำหนดนั้น
