บุคคลสองคนซึ่งเป็นญาติสืบสายโลหิตโดยตรงขึ้นไปหรือลงมาก็ดี เป็นพี่น้องร่วมบิดามารดาหรือร่วมแต่บิดาหรือมารดาก็ดี จะทำการสมรสกันไม่ได้ ความเป็นญาติดังกล่าวมานี้ให้ถือตามสายโลหิตโดยไม่คำนึงว่าจะเป็นญาติโดยชอบด้วยกฎหมายหรือไม่
