ถ้าคู่สมรสฝ่ายใดฝ่ายหนึ่งต้องคำพิพากษาให้ล้มละลาย สินสมรสย่อมแยกจากกันโดยอำนาจกฎหมายนับแต่วันที่ศาลพิพากษาให้ล้มละลายนั้น
