ในกรณีที่คู่สมรสฝ่ายใดฝ่ายหนึ่งเป็นคนวิกลจริตและมีเหตุหย่าเกิดขึ้นไม่ว่าเหตุนั้นจะได้เกิดขึ้นก่อนหรือภายหลังการเป็นคนวิกลจริต ให้บุคคลซึ่งอาจร้องขอต่อศาลให้สั่งให้บุคคลวิกลจริตเป็นคนไร้ความสามารถตามมาตรา ๒๘ มีอำนาจฟ้องคู่สมรสอีกฝ่ายหนึ่งขอให้ศาลพิพากษาให้หย่าขาดจากกันและแบ่งทรัพย์สินได้ ในกรณีเช่นว่านี้ ถ้ายังมิได้มีคำสั่งของศาลแสดงว่าคู่สมรสซึ่งวิกลจริตเป็นคนไร้ความสามารถก็ให้บุคคลดังกล่าวขอร้องขอต่อศาลในคดีเดียวกันนั้นให้ศาลมีคำสั่งว่าคู่สมรสซึ่งวิกลจริตนั้นเป็นคนไร้ความสามารถ เมื่อบุคคลดังกล่าวเห็นสมควร จะร้องขอต่อศาลให้มีคำสั่งตามมาตรา ๑๕๒๖ หรือมาตรา ๑๕๓๐ ด้วยก็ได้ ในกรณีที่คู่สมรสซึ่งถูกอ้างว่าเป็นคนวิกลจริตยังไม่ได้ถูกสั่งให้เป็นคนไร้ความสามารถ หากศาลเห็นว่าคู่สมรสนั้นยังไม่เป็นคนที่ควรสั่งให้เป็นคนไร้ความสามารถก็ให้ยกฟ้องคดีนั้นเสีย ถ้าเห็นว่าเป็นบุคคลที่ควรสั่งให้เป็นคนไร้ความสามารถ แต่ยังไม่สมควรจะให้มีการหย่า ก็ให้ศาลสั่งให้คู่สมรสนั้นเป็นคนไร้ความสามารถโดยไม่จะสั่งเรื่องผู้อนุบาลหรือจะตั้งผู้อื่นเป็นผู้อนุบาลตามมาตรา ๑๔๖๓ ก็ได้ คงพิพากษายกแต่เฉพาะข้อหย่า ในกรณีเช่นนี้ศาลจะสั่งกำหนดค่าเลี้ยงชีพด้วยก็ได้ ในกรณีที่ศาลเห็นว่าคู่สมรสนั้นวิกลจริตอันควรสั่งให้เป็นคนไร้ความสามารถและทั้งมีเหตุควรให้หย่าด้วย ก็ให้ศาลสั่งในคำพิพากษาให้คู่สมรสนั้นเป็นคนไร้ความสามารถ ตั้งผู้อนุบาลและให้หย่า ในกรณีนี้ ถ้าศาลเห็นว่าเหตุหย่าที่ยกขึ้นอ้างในการฟ้องร้องนั้นไม่เหมาะสมแก่สภาพของคู่สมรสซึ่งเป็นคนไร้ความสามารถที่จะหย่าจากคู่สมรสอีกฝ่ายหนึ่งก็ดี ตามพฤติการณ์ไม่สมควรที่จะให้มีการหย่าขาดจากกันก็ดี ศาลจะพิพากษาไม่ให้หย่าก็ได้ หมายเหตุ: [เลขมาตรา ๒๘ แก้ไขเพิ่มเติมโดยมาตรา ๑๕ แห่งพระราชบัญญัติให้ใช้บทบัญญัติบรรพ ๑ แห่งประมวลกฎหมายแพ่งและพาณิชย์ที่ได้ตรวจชำระใหม่ พ.ศ. ๒๕๓๕]

Where one spouse is of unsound mind and a ground for divorce arises, whether that ground arose before or after the unsoundness of mind, the person who may apply to the court for an order adjudging a person of unsound mind incompetent under Section 28 has power to bring an action against the other spouse asking the court to give judgment dissolving the marriage and dividing the property. In such a case, if no order of the court has yet adjudged the spouse of unsound mind incompetent, that person shall apply to the court in the same case for an order adjudging that spouse incompetent. That person may also, if he thinks fit, apply to the court for an order under Section 1526 or Section 1530.
Where the spouse alleged to be of unsound mind has not yet been adjudged incompetent, if the court is of opinion that that spouse is not a person who ought to be adjudged incompetent, the court shall dismiss the case. If the court is of opinion that that spouse ought to be adjudged incompetent but that a divorce ought not yet to be granted, the court shall adjudge that spouse incompetent, and may either make no order as to the guardian or appoint another person as guardian under Section 1463, and shall give judgment dismissing only the claim for divorce. In such a case the court may also fix a living allowance.
Where the court is of opinion that the spouse is of unsound mind and ought to be adjudged incompetent, and that there is also a ground on which a divorce ought to be granted, the court shall, in its judgment, adjudge that spouse incompetent, appoint a guardian and grant the divorce. In this case, if the court is of opinion that the ground for divorce relied on in the action is not appropriate to the condition of the incompetent spouse who is to be divorced from the other spouse, or that in the circumstances the marriage ought not to be dissolved, the court may give judgment refusing the divorce.
