ผู้จะรับบุตรบุญธรรมหรือผู้จะเป็นบุตรบุญธรรม ถ้ามีคู่สมรสอยู่ต้องได้รับความยินยอมจากคู่สมรสก่อน ในกรณีที่คู่สมรสไม่อาจให้ความยินยอมได้หรือไปเสียจากภูมิลำเนาหรือถิ่นที่อยู่และหาตัวไม่พบเป็นเวลาไม่น้อยกว่าหนึ่งปี ต้องร้องขอต่อศาลให้มีคำสั่งอนุญาตแทนการให้ความยินยอมของคู่สมรสนั้น

Une personne mariée qui souhaite adopter ou être adoptée doit obtenir le consentement de son conjoint. Si ce dernier ne peut donner son consentement ou a quitté le domicile conjugal et qu'on est sans nouvelles de lui depuis au moins un an, une demande d'autorisation d'adoption doit être présentée au tribunal.
