Article 1606: Exclusion from an inheritance for unworthiness

บุคคลดังต่อไปนี้ต้องถูกกำจัดมิให้รับมรดกฐานเป็นผู้ไม่สมควร คือ
(๑) ผู้ที่ต้องคำพิพากษาถึงที่สุดว่าได้เจตนากระทำ หรือพยายามกระทำให้เจ้ามรดกหรือผู้มีสิทธิได้รับมรดกก่อนตนถึงแก่ความตายโดยมิชอบด้วยกฎหมาย
(๒) ผู้ที่ได้ฟ้องเจ้ามรดกหาว่าทำความผิดโทษประหารชีวิตและตนเองกลับต้องคำพิพากษาถึงที่สุดว่า มีความผิดฐานฟ้องเท็จหรือทำพยานเท็จ
(๓) ผู้ที่รู้แล้วว่า เจ้ามรดกถูกฆ่าโดยเจตนา แต่มิได้นำข้อความนั้นขึ้นร้องเรียนเพื่อเป็นทางที่จะเอาตัวผู้กระทำผิดมาลงโทษ แต่ข้อนี้มิให้ใช้บังคับถ้าบุคคลนั้นมีอายุยังไม่ครบสิบหกปีบริบูรณ์ หรือเป็นคนวิกลจริตไม่สามารถรู้ผิดชอบ หรือถ้าผู้ที่ฆ่านั้นเป็นคู่สมรส หรือผู้บุพการีหรือผู้สืบสันดานของตนโดยตรง
(๔) ผู้ที่ฉ้อฉลหรือข่มขู่ให้เจ้ามรดกทำ หรือเพิกถอนหรือเปลี่ยนแปลงพินัยกรรมแต่บางส่วนหรือทั้งหมดซึ่งเกี่ยวกับทรัพย์มรดก หรือไม่ให้กระทำการดังกล่าวนั้น
(๕) ผู้ที่ปลอม ทำลาย หรือปิดบังพินัยกรรมแต่บางส่วนหรือทั้งหมด
เจ้ามรดกอาจถอนข้อกำจัดฐานเป็นผู้ไม่สมควรเสียก็ได้โดยให้อภัยไว้เป็นลายลักษณ์อักษร

English translation
The following persons are excluded from an inheritance as being unworthy:
(1) a person against whom a final judgment has been given that he intentionally caused, or attempted to cause, the unlawful death of the de cujus, or of a person entitled to inherit before him;
(2) a person who accused the de cujus of an offence punishable by death and was himself found guilty by a final judgment of false accusation or of giving false evidence;
(3) a person who knew that the de cujus had been intentionally killed but did not report it so that the offender might be punished; but this does not apply if that person had not completed sixteen years of age, or was of unsound mind and unable to distinguish right from wrong, or if the killer was that person's spouse, or a direct ascendant or descendant of that person;
(4) a person who by fraud or duress caused the de cujus to make, revoke or alter, in whole or in part, a will concerning the estate, or prevented him from doing so;
(5) a person who forged, destroyed or concealed a will, in whole or in part.
The de cujus may withdraw the exclusion for unworthiness by a pardon given in writing.
