โมฆียะกรรมนั้นจะบอกล้างมิได้เมื่อพ้นเวลาหนึ่งปีนับแต่เวลาที่อาจให้สัตยาบันได้ หรือเมื่อพ้นเวลาสิบปีนับแต่ได้ทำนิติกรรมอันเป็นโมฆียะนั้น
