Sauf dans les cas mentionnés aux deux sections précédentes, si l'exécution d'une obligation devient impossible du fait d'une cause non imputable à l'une ou l'autre des parties, le débiteur n'a pas droit à la contrepartie. Si l'exécution devient impossible du fait d'une cause imputable au créancier, le débiteur conserve son droit à la contrepartie. Il doit cependant déduire de l'exécution ce qu'il économise du fait de la libération de son obligation, ou ce qu'il acquiert ou omet volontairement d'acquérir par un autre usage de ses facultés. La même règle s'applique lorsque l'exécution d'une obligation due par une partie devient impossible, du fait d'une circonstance dont elle n'est pas responsable, au moment où l'autre partie est en défaut d'acceptation.
