Si un dommage résulte d'un défaut de construction ou d'un entretien insuffisant d'un bâtiment ou autre ouvrage, le propriétaire de ce bâtiment ou ouvrage est tenu d'indemniser le dommage. Toutefois, s'il a pris toutes les précautions nécessaires pour éviter le dommage, c'est le propriétaire qui est tenu d'indemniser le dommage. Les dispositions du paragraphe précédent s'appliquent également aux défauts de plantation ou d'étaiement des arbres ou des bambous. Si, dans les cas visés aux deux paragraphes précédents, une autre personne est également responsable du dommage, le propriétaire peut exercer un recours contre elle.
