Si le défaut n'est pas de nature à priver le locataire de la jouissance du bien loué et peut être remédié par le locataire, ce dernier doit d'abord en informer le locataire afin qu'il y remédie. Si le défaut n'est pas remédié dans un délai raisonnable, le locataire peut résilier le contrat si le défaut est suffisamment grave pour justifier cette résiliation.
