Si un créancier refuse l'offre, il doit intenter une action en justice dans un délai d'un mois à compter de la date de l'offre pour obtenir un jugement ordonnant la vente aux enchères publiques du bien hypothéqué, à condition que : (1) Il avance les frais de vente ; (2) Il s'engage à faire une offre ou à faire faire une offre supérieure à la somme offerte par le cessionnaire, et (3) Il notifie son refus au cessionnaire, aux autres créanciers inscrits, à l'ancien propriétaire et au débiteur principal.
