อันสัญญาประนีประนอมยอมความนั้น ถ้ามิได้มีหลักฐานเป็นหนังสืออย่างใดอย่างหนึ่งลงลายมือชื่อฝ่ายที่ต้องรับผิด หรือลายมือชื่อตัวแทนของฝ่ายนั้นเป็นสำคัญ ท่านว่าจะฟ้องร้องให้บังคับคดีหาได้ไม่
