เมื่อใดความที่สลักหลังมีข้อกำหนดว่า “ราคาเป็นประกัน” ก็ดี “ราคาเป็นจำนำ” ก็ดี หรือข้อกำหนดอย่างอื่นใดอันเป็นปริยายว่าจำนำไซร้ ท่านว่าผู้ทรงตั๋วแลกเงินจะใช้สิทธิทั้งปวงอันเกิดแต่ตั๋วนั้นก็ย่อมได้ทั้งสิ้น แต่ถ้าผู้ทรงสลักหลังตั๋วนั้น ท่านว่าการสลักหลังย่อมใช้ได้เพียงในฐานเป็นคำสลักหลังของตัวแทนคู่สัญญาทั้งหลายซึ่งต้องรับผิดหาอาจจะต่อสู้ผู้ทรงด้วยข้อต่อสู้อันอาศัยความเกี่ยวพันเฉพาะบุคคลระหว่างตนกับผู้สลักหลังนั้นได้ไม่ เว้นแต่การสลักหลังจะได้มีขึ้นด้วยคบคิดกันฉ้อฉลส่วนที่ ๒การรับรอง

English translation
Where an endorsement contains the words "value in security", "value in pledge", or any other expression implying a pledge, the holder of the bill of exchange may exercise all the rights arising out of it; but if the holder endorses it, the endorsement operates only as the endorsement of an agent. The parties liable cannot set up against the holder defences founded on their personal relations with the endorser, unless the endorsement was made in furtherance of a fraudulent scheme.
