Article 218: Court judgment on an arbitration award

ให้นำบทบัญญัติมาตรา ๑๔๐, ๑๔๑ และ ๑๔๒ ว่าด้วยคำพิพากษาและคำสั่งของศาลมาใช้บังคับแก่คำชี้ขาดของอนุญาโตตุลาการโดยอนุโลมให้อนุญาโตตุลาการยื่นคำชี้ขาดของตนต่อศาล และให้ศาลพิพากษาตามคำชี้ขาดนั้นแต่ถ้าศาลเห็นว่า คำชี้ขาดของอนุญาโตตุลาการขัดต่อกฎหมายประการใดประการหนึ่ง ให้ศาลมีอำนาจทำคำสั่งปฏิเสธไม่ยอมพิพากษาตามคำชี้ขาดนั้น แต่ถ้าคำชี้ขาดนั้นอาจแก้ไขให้ถูกต้องได้ ศาลอาจให้อนุญาโตตุลาการหรือคู่ความที่เกี่ยวข้องแก้ไขเสียก่อนภายในเวลาอันสมควรที่ศาลจะกำหนดไว้
English translation
The provisions of Sections 140, 141 and 142 concerning judgments and orders of the court shall apply mutatis mutandis to the award of the arbitrators. The arbitrators shall submit their award to the court, and the court shall render judgment in accordance with that award. However, if the court is of the opinion that the arbitrators' award is contrary to any provision of law, the court shall have the power to make an order refusing to render judgment in accordance with the award. But if the award can be corrected, the court may allow the arbitrators or the parties concerned to correct it first within a reasonable time to be fixed by the court.

This section links the arbitration process back to the court's judgment machinery. It borrows Sections 140, 141 and 142 (on how judgments and orders are pronounced, drawn up and confined to the issues) and applies them to arbitration awards. Two safeguards stand out: the court is not a rubber stamp and must refuse to enter judgment on an award that is contrary to law, and where the defect is curable it may return the award for correction rather than reject it outright. The court's power to refuse an unlawful award, under the last paragraph, is a recurring theme in disputes where committee decisions are enforced through the arbitration provisions by reference.
Why this matters in practice
Winning at arbitration is not the end: the court still reviews the award for legality before turning it into an enforceable judgment, so a party opposing enforcement should focus its argument on how the award breaks the law rather than re-arguing the facts. If the award has a fixable technical flaw, ask the court for leave to correct it rather than let the whole award fall. Where a special law directs that the arbitration provisions of the Civil Procedure Code apply to a committee's decision, the court has the power under the last paragraph of Section 218 to refuse to render judgment on that decision if it is contrary to law.
A land-rent dispute was brought to court to enforce a local land rent committee decision under Section 58 of the Agricultural Land Rent Act, which applies the Code's arbitration rules. The court confirmed it had power to refuse the decision under Section 218 if unlawful, but because the defendant only argued non-compliance and never pleaded that the committee decision was itself unlawful, the plaintiff kept the right to buy the land.
