ในกรณีที่มีการยึดทรัพย์สินซึ่งมิใช่ตัวเงิน หรือในกรณียึดหรืออายัดเงิน หรืออายัดทรัพย์สินแล้วไม่มีการขายหรือจำหน่ายเนื่องจากเจ้าพนักงานบังคับคดีถอนการบังคับคดีนั้นเองหรือถอนโดยคำสั่งศาล และผู้ขอให้ยึดหรืออายัดไม่ชำระค่าฤชาธรรมเนียมในการบังคับคดี ให้เจ้าพนักงานบังคับคดีรายงานต่อศาลขอให้บังคับคดีแก่ทรัพย์สินของผู้นั้นเพื่อชำระค่าฤชาธรรมเนียมในการบังคับคดี ในกรณีเช่นว่านี้ ให้ถือว่าเจ้าพนักงานบังคับคดีเป็นเจ้าหนี้ตามคำพิพากษา และผู้ขอให้ยึดหรืออายัดเป็นลูกหนี้ตามคำพิพากษาในส่วนที่เกี่ยวกับค่าฤชาธรรมเนียมในการบังคับคดีนั้น และให้เจ้าพนักงานบังคับคดีบังคับคดีได้เอง โดยได้รับยกเว้นค่าธรรมเนียมทั้งปวง
English translation
Where property other than money has been seized, or where money has been seized or attached, or a claim attached, and there has been no sale or disposal because the executing officer has withdrawn the execution on his own or by order of the court, and the person who applied for the seizure or attachment does not pay the execution fees, the executing officer shall report to the court and request execution against that person's property for payment of the execution fees. In such case, the executing officer shall be deemed the judgment creditor and the person who applied for the seizure or attachment the judgment debtor as regards those execution fees, and the executing officer may carry out the execution himself, exempt from all fees.

Section 294 secures payment of execution fees when a seizure or attachment is withdrawn before any sale, leaving fees outstanding. It creates a self-help enforcement track: the executing officer reports to the court and, by a statutory fiction, becomes a judgment creditor against the applicant as judgment debtor for the fees, enforcing without paying further fees. It thus complements Section 292 on withdrawal and Section 169/2 on who bears execution costs, and it discourages applicants from abandoning seizures at the state's expense. The section reflects the 2017 renumbering; older decisions numbered 294 dealt with resuming a stayed execution, now covered by Section 291.

The practical warning for a creditor is that asking the officer to seize property carries a cost even if nothing is ever sold: if you later withdraw and leave the seizure-without-sale fees unpaid, the officer can turn around and enforce those fees against your own assets. Section 294 makes the person who applied for a seizure liable for the execution fees where seized property is not sold, treating the executing officer as judgment creditor for those fees; whether the applicant must actually pay depends on why no sale occurred.
The dispute was whether the applicant had to pay the fee for property seized but not sold, invoked under Section 294, after the seized building was demolished by the local authority under the Building Control Act. The Court treated Section 294 as the source of the seizure-without-sale fee rule while examining whether, on these facts, the applicant was in fact liable.
