มูลนิธิได้แก่ทรัพย์สินที่จัดสรรไว้โดยเฉพาะสำหรับวัตถุประสงค์เพื่อการกุศล สาธารณะ การศาสนา ศิลปะ วิทยาศาสตร์ วรรณคดี การศึกษา หรือเพื่อสาธารณประโยชน์อย่างอื่น โดยมิได้มุ่งหาผลประโยชน์มาแบ่งปันกัน และได้จดทะเบียนตามบทบัญญัติแห่งประมวลกฎหมายนี้ การจัดการทรัพย์สินของมูลนิธิ ต้องมิใช่เป็นการหาผลประโยชน์เพื่อบุคคลใดนอกจากเพื่อดำเนินการตามวัตถุประสงค์ของมูลนิธินั้นเอง

Une fondation est constituée de biens spécialement affectés à des fins caritatives, religieuses, artistiques, scientifiques, éducatives ou autres, d'intérêt public et non à but lucratif, et enregistrée conformément aux dispositions du présent Code. Les biens d'une fondation doivent être gérés en vue de la réalisation de ses objectifs et non dans le but de procurer un intérêt à quiconque.
