Article 1440: What compensation may be claimed

ค่าทดแทนนั้นอาจเรียกได้ ดังต่อไปนี้
(๑) ทดแทนความเสียหายต่อกายหรือชื่อเสียงแห่งผู้หมั้นหรือผู้รับหมั้นนั้น
(๒) ทดแทนความเสียหายเนื่องจากการที่คู่หมั้น บิดามารดา หรือบุคคลผู้กระทำการในฐานะเช่นบิดามารดาได้ใช้จ่ายหรือต้องตกเป็นลูกหนี้เนื่องในการเตรียมการสมรสโดยสุจริตและตามสมควร
(๓) ทดแทนความเสียหายเนื่องจากการที่คู่หมั้นได้จัดการทรัพย์สินหรือการอื่นอันเกี่ยวแก่อาชีพหรือทางทำมาหาได้ของตนไปโดยสมควรด้วยการคาดหมายว่าจะได้มีการสมรส
ในกรณีที่ผู้รับหมั้นเป็นผู้มีสิทธิได้ค่าทดแทน ศาลอาจชี้ขาดว่าของหมั้นที่ตกเป็นสิทธิแก่ผู้รับหมั้นนั้นเป็นค่าทดแทนทั้งหมดหรือเป็นส่วนหนึ่งของค่าทดแทนที่ผู้รับหมั้นพึงได้รับ หรือศาลอาจให้ค่าทดแทนโดยไม่คำนึงถึงของหมั้นที่ตกเป็นสิทธิแก่ผู้รับหมั้นนั้นก็ได้

English translation
Compensation may be claimed as follows:
(1) for damage to the body or the reputation of the betrothing party or the betrothed party;
(2) for damage arising from the betrothed couple, their parents, or a person acting in the capacity of a parent, having spent money or incurred debt in good faith and reasonably in preparation for the marriage;
(3) for damage arising from a betrothed party having, in reasonable expectation of the marriage, dealt with property or taken other steps affecting their occupation or their means of earning a living.
Where the betrothed party is the person entitled to compensation, the court may decide that the khongman which has become that party's property is the whole or part of the compensation to be received, or the court may award compensation without regard to that khongman.
