ในกรณีที่ศาลสั่งให้คู่สมรสฝ่ายใดฝ่ายหนึ่งเป็นคนไร้ความสามารถหรือเสมือนไร้ความสามารถ คู่สมรสอีกฝ่ายหนึ่งย่อมเป็นผู้อนุบาลหรือผู้พิทักษ์ แต่เมื่อผู้มีส่วนได้เสียหรืออัยการร้องขอ และถ้ามีเหตุสำคัญ ศาลจะตั้งผู้อื่นเป็นผู้อนุบาลหรือผู้พิทักษ์ก็ได้

Where the court adjudges one spouse incompetent or quasi-incompetent, the other spouse is the guardian or the curator. But on the application of an interested person or of the public prosecutor, and where there is a material cause, the court may appoint another person as guardian or curator.
