Pour les avocats : un testateur sain d’esprit au moment de la signature est lié par son testament, même s’il devient ultérieurement incapable ; cette incapacité ultérieure n’invalide pas le testament. En revanche, si le légataire décède avant le testateur, le legs est caduc (article 1698) — le légataire doit avoir la capacité juridique au moment du décès du testateur. Pour les clients : une évaluation médicale au moment de la signature peut contribuer à établir la santé mentale du testateur en cas de contestation ultérieure du testament.

La capacité du testateur au sens de l'article 1654 n'est évaluée qu'au moment de la signature ; aucun certificat médical n'est requis pour les testaments officiels, car l'officier qui préside est compétent pour évaluer la santé mentale.
Un testament, établi selon la forme officielle, a été signé dans un hôpital. Le tribunal a jugé qu'aucune certification médicale de l'état mental du testateur n'était requise pour ce type de testament ; l'officier d'état civil ou son adjoint chargé de la signature étant compétent pour apprécier la santé mentale du testateur, et la capacité de ce dernier n'étant évaluée qu'au moment de la signature, le testament ne peut être établi.
