Un droit préférentiel acquis en raison de travaux effectués sur un immeuble conserve ses effets tant qu'une estimation provisoire du coût est enregistrée avant le début des travaux. Toutefois, si le coût des travaux excède cette estimation provisoire, le droit préférentiel est perdu pour le surplus. L'augmentation de valeur d'un immeuble résultant des travaux effectués est estimée par des experts désignés par le tribunal lors de son intervention dans le partage.
