ในวันชี้สองสถาน ให้คู่ความมาศาล และให้ศาลตรวจคำคู่ความและคำแถลงของคู่ความ แล้วนำข้ออ้าง ข้อเถียง ที่ปรากฏในคำคู่ความและคำแถลงของคู่ความเทียบกันดู และสอบถามคู่ความทุกฝ่ายถึงข้ออ้าง ข้อเถียง และพยานหลักฐานที่จะยื่นต่อศาลว่าฝ่ายใดยอมรับหรือโต้แย้งข้ออ้าง ข้อเถียงนั้นอย่างไร ข้อเท็จจริงใดที่คู่ความยอมรับกันก็เป็นอันยุติไปตามนั้น ส่วนข้อกฎหมายหรือข้อเท็จจริงที่คู่ความฝ่ายหนึ่งยกขึ้นอ้างแต่คู่ความฝ่ายอื่นไม่รับและเกี่ยวเนื่องโดยตรงกับประเด็นข้อพิพาทตามคำคู่ความให้ศาลกำหนดไว้เป็นประเด็นข้อพิพาท และกำหนดให้คู่ความฝ่ายใดนำพยานหลักฐานมาสืบในประเด็นข้อใดก่อนหรือหลังก็ได้ในการสอบถามคู่ความตามวรรคหนึ่ง คู่ความแต่ละฝ่ายต้องตอบคำถามที่ศาลถามเองหรือถามตามคำขอของคู่ความฝ่ายอื่น เกี่ยวกับข้อเท็จจริงที่คู่ความฝ่ายอื่นยกขึ้นเป็นข้ออ้าง ข้อเถียง และพยานหลักฐานต่าง ๆ ที่คู่ความจะยื่นต่อศาล ถ้าคู่ความฝ่ายใดไม่ตอบคำถามเกี่ยวกับข้อเท็จจริงใด หรือปฏิเสธข้อเท็จจริงใดโดยไม่มีเหตุผลอันสมควร ให้ถือว่ายอมรับข้อเท็จจริงนั้นแล้ว เว้นแต่คู่ความฝ่ายนั้นไม่อยู่ในวิสัยที่จะตอบหรือแสดงเหตุผลแห่งการปฏิเสธได้ในขณะนั้นคู่ความมีสิทธิคัดค้านว่าประเด็นข้อพิพาทหรือหน้าที่นำสืบที่ศาลกำหนดไว้นั้นไม่ถูกต้อง โดยแถลงด้วยวาจาต่อศาลในขณะนั้นหรือยื่นคำร้องต่อศาลภายในเจ็ดวันนับแต่วันที่ศาลสั่งกำหนดประเด็นข้อพิพาทหรือหน้าที่นำสืบ ให้ศาลชี้ขาดคำคัดค้านนั้นก่อนวันสืบพยาน คำชี้ขาดคำคัดค้านดังกล่าวให้อยู่ภายใต้บังคับมาตรา ๒๒๖

English translation

On the day of the settlement of issues, the parties shall come to court, and the court shall examine the pleadings and the statements of the parties, compare the allegations and arguments appearing in the pleadings and statements, and question all parties on their allegations, arguments, and the evidence to be submitted to the court, as to how each side admits or contests those allegations and arguments. Any fact admitted by the parties is thereby settled accordingly. As for a point of law or fact that one party raises but the other does not admit, and which is directly connected with the issues in dispute according to the pleadings, the court shall fix it as an issue in dispute, and shall determine which party is to adduce evidence on which issue first or later. In the questioning under the first paragraph, each party must answer the questions the court asks of its own motion or at the request of another party, concerning the facts that the other party raises as allegations or arguments and the various items of evidence the parties will submit to the court. If a party does not answer a question about any fact, or denies any fact without reasonable ground, that fact shall be deemed admitted, unless the party is not in a position to answer or to give the grounds of the denial at that time. A party has the right to object that the issues in dispute or the burden of proof fixed by the court are incorrect, by making an oral statement to the court at that time or by filing a motion with the court within seven days from the date the court fixed the issues in dispute or the burden of proof. The court shall rule on the objection before the day of taking evidence. Such ruling on the objection is subject to Section 226.

Section 183 sets out what actually happens at the settlement-of-issues hearing required by Section 182. The court compares the pleadings, questions the parties, and separates admitted facts, which are settled, from genuinely contested points, which are fixed as the issues in dispute, and it allocates the order of proof. A party who, without reasonable ground, refuses to answer or denies a fact may be deemed to have admitted it. Crucially, the issues framed here define the outer limits of the trial and the judgment: courts have repeatedly held it improper to decide a matter that was not framed as an issue, or to omit one that should have been. Objections to the framing must be raised at once or within seven days, and the ruling is subject to the appeal restriction in Section 226.

Why this matters in practice

This hearing is where cases are quietly won or lost. Come prepared to state clearly what you admit and what you contest, because a fact you decline to answer without good reason can be deemed admitted, and a point never framed as an issue usually cannot be decided in your favour later. If you think the court has framed the issues or the burden of proof wrongly, object on the spot or file within seven days, do not let it slide, since the ruling ties to the appeal limits in Section 226.

  1. Arrêt de la Cour suprême n° 6525/2559 (2016)

    Failing to frame an issue in dispute over a defence properly raised in the answer is an improper proceeding under Section 183, read with Section 26 of the Intellectual Property and International Trade Court Act. The reviewing court may then decide the omitted issue where the evidence is sufficient.

    The trial court did not frame an issue on the defendant's pleaded copyright-exception defence. Holding this improper under Section 183, the Supreme Court's IP and International Trade Division decided the omitted issue itself, the evidence being sufficient.

  2. Arrêt de la Cour suprême n° 2765/2559 (2016)

    Whether the issue in dispute framed at the settlement of issues, here the liability of an agent for a foreign principal, was fixed in accordance with Section 183 is assessed against the pleadings and the parties' contentions.

    The Court examined whether the framed issue on the agent's liability to the plaintiff complied with Section 183, read with Section 26 of the Intellectual Property and International Trade Court Act, against the plaintiff's pleaded contract-and-survey claim.

  3. Arrêt de la Cour suprême n° 583/2558 (2015)

    Where the case presents an issue of the plaintiff's standing to sue, deciding the case without ruling on that issue is improper under Section 142 read with Section 183. Standing is a matter of public order the reviewing court may take up itself.

    The trial court gave judgment without deciding the framed issue of the plaintiff's standing, and the appellate court did not cure it. The Court held this improper under Sections 142 and 183 and, standing being a public-order question, decided it directly.
