traduction anglaise
In the cases referred to in Section 202 and Section 204, if the court is not yet satisfied that the summons fixing the date for taking evidence has been duly served so as to inform the party in default, the court shall order the date for taking evidence to be postponed and shall prescribe such method as it thinks fit for a fresh summons fixing the date for taking evidence to be served on the party in default of appearance, whether by ordinary service or by another method in lieu. If this has been done and that party still fails to appear before the taking of evidence begins on the date fixed in that summons, the court shall proceed with the case as provided in Section 202 or Section 204, as the case may be.

Annotation de l'entreprise
Section 205 is a due process safeguard woven between Sections 202 and 204. Default consequences are severe, so the section forbids the court from acting on a party's absence until it is satisfied the hearing summons reached the defaulting party through proper service. If not satisfied, the court must postpone and arrange fresh service, by ordinary service or an alternative method. Only after a duly served party fails to appear may the court fall back on Section 202 (plaintiff default, strike-out) or Section 204 (defendant default, ex parte trial). Note that earlier case law citing an old Section 205 addressed a different subject, the proof of merit now governed by Section 206 and Section 198 bis; that earlier text is not the current provision.
Pourquoi cela est important en pratique
Section 205 is a lifeline for a party who never actually received the summons. If a default judgment or strike-out was based on service you can show was not proper, the process itself was flawed and can be attacked. Keep proof of your correct address on the court file, and if you learn of a hearing you were never told about, raise defective service at the first opportunity. Foire aux questions
Can a court proceed by default if the summons was not properly served?
No. Section 205 requires the court to be satisfied the hearing summons was duly served before applying Section 202 or 204. If service is doubtful, it must postpone and order fresh service.
What if I was never told about the hearing date?
If the summons was not duly served, any default step taken against you is flawed. Section 205 obliges the court to re-serve; you should raise defective service at the first opportunity.
