ในกรณีที่จะต้องมีการชันสูตรพลิกศพ ให้พนักงานสอบสวนแห่งท้องที่ที่ศพนั้นอยู่กับแพทย์ทางนิติเวชศาสตร์ซึ่งได้รับวุฒิบัตรหรือได้รับหนังสืออนุมัติจากแพทย์สภา ทำการชันสูตรพลิกศพโดยเร็ว
ถ้าแพทย์ทางนิติเวชศาสตร์ดังกล่าวไม่มีหรือไม่อาจปฏิบัติหน้าที่ได้
ให้แพทย์ประจำโรงพยาบาลของรัฐปฏิบัติหน้าที่ ถ้าแพทย์ประจำโรงพยาบาลของรัฐไม่มีหรือไม่อาจปฏิบัติหน้าที่ได้ให้แพทย์ประจำสำนักงานสาธารณสุขจังหวัดปฏิบัติหน้าที่ถ้าแพทย์ประจำสำนักงานสาธารณสุขจังหวัดไม่มีหรือไม่อาจปฏิบัติหน้าที่ได้
ให้แพทย์ประจำโรงพยาบาลของเอกชนหรือแพทย์ผู้ประกอบวิชาชีพเวชกรรมที่ขึ้นทะเบียนเป็นแพทย์อาสาสมัครตามระเบียบของกระทรวงสาธารณสุขปฏิบัติหน้าที่
และในการปฏิบัติหน้าที่ดังกล่าว ให้แพทย์ประจำโรงพยาบาลของเอกชนหรือแพทย์ผู้ประกอบวิชาชีพเวชกรรมผู้นั้น
เป็นเจ้าพนักงานตามประมวลกฎหมายอาญา ทั้งนี้
ให้พนักงานสอบสวนและแพทย์ดังกล่าวทำบันทึกรายละเอียดแห่งการชันสูตรพลิกศพทันที
และให้แพทย์ดังกล่าวทำรายงานแนบท้ายบันทึกรายละเอียดแห่งการชันสูตรพลิกศพด้วยภายในเจ็ดวันนับแต่วันที่ได้รับแจ้งเรื่อง
ถ้ามีความจำเป็นให้ขยายระยะเวลาออกไปได้ไม่เกินสองครั้ง ครั้งละไม่เกินสามสิบวัน
แต่ต้องบันทึกเหตุผลและความจำเป็นในการขยายระยะเวลาทุกครั้งไว้ในสำนวนชันสูตรพลิกศพ รายงานดังกล่าวให้ถือเป็นส่วนหนึ่งของสำนวนชันสูตรพลิกศพ และในกรณีที่ความตายมิได้เป็นผลแห่งการกระทำผิดอาญา
ให้พนักงานสอบสวนส่งสำนวนชันสูตรพลิกศพไปยังพนักงานอัยการเมื่อเสร็จสิ้นการชันสูตรพลิกศพโดยเร็วและให้พนักงานอัยการดำเนินการต่อไปตามมาตรา ๑๕๖
ให้เป็นหน้าที่ของพนักงานสอบสวนแจ้งแก่ผู้มีหน้าที่ไปทำการชันสูตรพลิกศพทราบ และก่อนการชันสูตรพลิกศพ ให้พนักงานสอบสวนแจ้งให้สามี
ภริยา ผู้บุพการี ผู้สืบสันดาน ผู้แทนโดยชอบธรรม ผู้อนุบาล
หรือญาติของผู้ตายอย่างน้อยหนึ่งคนทราบเท่าที่จะทำได้

เมื่อได้มีการชันสูตรพลิกศพตามวรรคสามแล้ว
ให้พนักงานสอบสวนแจ้งให้พนักงานอัยการเข้าร่วมกับพนักงานสอบสวนทำสำนวนชันสูตรพลิกศพให้เสร็จภายในสามสิบวันนับแต่วันที่ได้รับแจ้ง
ถ้ามีความจำเป็นให้ขยายระยะเวลาออกไปได้ไม่เกินสองครั้ง ครั้งละไม่เกินสามสิบวันแต่ต้องบันทึกเหตุผลและความจำเป็นในการขยายระยะเวลาทุกครั้งไว้ในสำนวนชันสูตรพลิกศพ
เมื่อได้รับสำนวนชันสูตรพลิกศพแล้ว
ให้พนักงานอัยการทำคำร้องขอต่อศาลชั้นต้นแห่งท้องที่ที่ศพนั้นอยู่
เพื่อให้ศาลทำการไต่สวนและทำคำสั่งแสดงว่าผู้ตายคือใคร ตายที่ไหน เมื่อใด
และถึงเหตุและพฤติการณ์ที่ตาย
ถ้าตายโดยคนทำร้ายให้กล่าวว่าใครเป็นผู้กระทำร้ายเท่าที่จะทราบได้
ภายในสามสิบวันนับแต่วันที่ได้รับสำนวน ถ้ามีความจำเป็น ให้ขยายระยะเวลาออกไปได้ไม่เกินสองครั้ง
ครั้งละไม่เกินสามสิบวัน
แต่ต้องบันทึกเหตุผลและความจำเป็นในการขยายระยะเวลาทุกครั้งไว้ในสำนวนชันสูตรพลิกศพ

ให้ศาลปิดประกาศแจ้งกำหนดวันที่จะทำการไต่สวนไว้ที่ศาล
และให้พนักงานอัยการยื่นคำร้องต่อศาลขอให้ศาลส่งสำเนาคำร้องและแจ้งกำหนดวันนัดไต่สวนให้สามี ภริยา ผู้บุพการี ผู้สืบสันดาน
ผู้แทนโดยชอบธรรม ผู้อนุบาล หรือญาติของผู้ตายตามลำดับอย่างน้อยหนึ่งคนเท่าที่จะทำได้ทราบก่อนวันนัดไต่สวนไม่น้อยกว่าสิบห้าวันและให้พนักงานอัยการนำพยานหลักฐานทั้งปวงที่แสดงถึงการตายมาสืบ
เมื่อศาลได้ปิดประกาศแจ้งกำหนดวันที่จะทำการไต่สวนแล้ว
และก่อนการไต่สวนเสร็จสิ้น สามี ภริยา ผู้บุพการี ผู้สืบสันดาน
ผู้แทนโดยชอบธรรม ผู้อนุบาล หรือญาติของผู้ตายมีสิทธิยื่นคำร้องต่อศาลขอเข้ามาซักถามพยานที่พนักงานอัยการนำสืบและนำสืบพยานหลักฐานอื่นได้ด้วย เพื่อการนี้ สามี ภริยา ผู้บุพการี
ผู้สืบสันดาน ผู้แทนโดยชอบธรรม ผู้อนุบาลหรือญาติของผู้ตายมีสิทธิแต่งตั้งทนายความดำเนินการแทนได้
หากไม่มีทนายความที่ได้รับการแต่งตั้งจากบุคคลดังกล่าวเข้ามาในคดีให้ศาลตั้งทนายความขึ้นเพื่อทำหน้าที่ทนายความฝ่ายญาติผู้ตาย
เมื่อศาลเห็นสมควรเพื่อประโยชน์แห่งความยุติธรรม
ศาลจะเรียกพยานที่นำสืบมาแล้วมาสืบเพิ่มเติมหรือเรียกพยานหลักฐานอื่นมาสืบก็ได้
และศาลอาจขอให้ผู้ทรงคุณวุฒิหรือผู้เชี่ยวชาญมาให้ความเห็นเพื่อประกอบการไต่สวนและทำคำสั่ง
แต่ทั้งนี้ ไม่ตัดสิทธิของผู้นำสืบพยานหลักฐานตามวรรคแปดที่จะขอให้เรียกผู้ทรงคุณวุฒิหรือผู้เชี่ยวชาญอื่นมาให้ความเห็นโต้แย้งหรือเพิ่มเติมความเห็นของผู้ทรงคุณวุฒิหรือผู้เชี่ยวชาญดังกล่าว
คำสั่งของศาลตามมาตรานี้ให้ถึงที่สุด

English translation
Where an inquest is to be held, the inquiry official of the locality where the corpse is located shall, together with a forensic-medicine physician who holds a diploma or a certificate of approval from the Medical Council, conduct the inquest without delay. If no such forensic-medicine physician is available or is unable to perform the duty, a physician attached to a government hospital shall perform it; if no physician attached to a government hospital is available or is unable to perform the duty, a physician attached to the Provincial Public Health Office shall perform it; if no physician attached to the Provincial Public Health Office is available or is unable to perform the duty, a physician attached to a private hospital or a medical practitioner registered as a volunteer physician under the regulations of the Ministry of Public Health shall perform it; and in performing such duty, that physician of a private hospital or that medical practitioner shall be an official under the Penal Code. The inquiry official and the said physician shall immediately make a record of the details of the inquest, and the physician shall prepare a report appended to the record of the details of the inquest within seven days from the day of being notified of the matter; if there is necessity, the period may be extended not more than twice, each not exceeding thirty days, but the reasons and necessity for each extension must be recorded in the inquest file. Such report shall be deemed part of the inquest file. And where the death was not the result of a criminal offence, the inquiry official shall send the inquest file to the public prosecutor promptly upon completion of the inquest, and the public prosecutor shall proceed further under section 156.
It shall be the duty of the inquiry official to notify the persons whose duty it is to conduct the inquest, and before the inquest, the inquiry official shall notify the husband, wife, ascendant, descendant, legal representative, guardian, or a relative of the deceased, at least one person, so far as can be done.
Where a death occurs by the act of an official claiming to act in the course of duty, or the deceased died while in the custody of an official claiming to act in the course of duty, the public prosecutor and an administrative official holding a position from the level of assistant district officer or equivalent upward of the locality where the corpse is located shall conduct the inquest together with the inquiry official and the physician under paragraph one, and the provisions of paragraph two shall apply.
When the inquest under paragraph three has been conducted, the inquiry official shall notify the public prosecutor to join with the inquiry official in completing the inquest file within thirty days from the day of notification; if there is necessity, the period may be extended not more than twice, each not exceeding thirty days, but the reasons and necessity for each extension must be recorded in the inquest file.
Upon receiving the inquest file, the public prosecutor shall file a motion with the Court of First Instance of the locality where the corpse is located, for the court to hold an inquiry and make an order stating who the deceased is, where and when the death occurred, and the cause and circumstances of death; and if death was caused by another person's act, stating who caused it so far as can be ascertained, within thirty days from the day of receiving the file; if there is necessity, the period may be extended not more than twice, each not exceeding thirty days, but the reasons and necessity for each extension must be recorded in the inquest file.
In performing duties under paragraphs one, three, four, and five, the inquiry official shall comply with the orders of the public prosecutor.
In the inquiry under paragraph five, the court shall post a notice announcing the date on which the inquiry will be held at the court, and the public prosecutor shall file a motion with the court requesting the court to send a copy of the motion and notify the date of the inquiry to the husband, wife, ascendant, descendant, legal representative, guardian, or relatives of the deceased in order, at least one person so far as can be done, not less than fifteen days before the date of inquiry; and the public prosecutor shall adduce all evidence showing the death.
When the court has posted the notice announcing the date of the inquiry, and before the inquiry is concluded, the husband, wife, ascendant, descendant, legal representative, guardian, or relatives of the deceased have the right to file a motion with the court to enter and cross-examine the witnesses adduced by the public prosecutor and to adduce other evidence. For this purpose, such persons have the right to appoint a lawyer to act on their behalf. If no lawyer appointed by such persons enters the case, the court shall appoint a lawyer to act as counsel for the side of the deceased's relatives.
When the court sees fit for the interest of justice, the court may recall witnesses already adduced for further examination or call other evidence, and the court may request a qualified person or an expert to give an opinion to accompany the inquiry and the making of the order; but this shall not preclude the right of a person adducing evidence under paragraph eight to request that another qualified person or expert be called to give an opinion contradicting or supplementing that of the said qualified person or expert.
The order of the court under this section shall be final, but shall not affect the right to bring an action and the trial and adjudication of the court, if the public prosecutor or another person has brought or will bring an action concerning that death.
When the court has made its order, the record of the court's inquiry shall be sent to the public prosecutor to forward to the inquiry official to proceed further.
The physician under paragraph one, the officials who conducted the inquest, and the qualified persons or experts whom the court requested to give an opinion under this section are entitled to receive remuneration or an allowance, travel expenses, and accommodation charges according to the regulations prescribed by the Ministry of Justice with the approval of the Ministry of Finance. As for the lawyer appointed by the court under this section, he is entitled to receive a reward and expenses in the same manner as a lawyer appointed by the court under section 173.

This is the operational core of Chapter 2. Its first paragraph fixes the inquest team and a strict priority list of physicians, deems certain private physicians officials under the Penal Code, and sets time limits for the report. Paragraphs three to five create the enhanced procedure for custodial and duty-related deaths: a four-person inquest and a mandatory court inquiry to establish identity, place, time, cause, and circumstances of death, with family notification and participation rights and a court-appointed lawyer for the relatives. The court's order is final but does not bind any later criminal trial. The section carefully separates the fact-finding inquest from the question of guilt.
Why this matters in practice
For a family whose relative died in police or official custody, this section is your route into a formal court inquiry: you are entitled to be notified at least fifteen days ahead, to cross-examine the prosecutor's witnesses, to bring your own evidence, and to a court-appointed lawyer if you have none. The inquest must be done properly, and courts have voided findings where a doctor did not personally examine the body. Because the process is fast-moving and technical, families should get advice early on what to know before you go to court in Thailand.

Where the trial court dismisses an inquest petition on the ground that the applicant has no standing, because it takes the view that no lawful inquest under section 150 was carried out, that order is not an order made under section 150 paragraph five. It is therefore not final under section 150 paragraph ten, and an appeal against it lies. An appellate court that dismisses such an appeal as barred is wrong, and the case will be remitted so that the appeal is decided in the proper order of instances.
The public prosecutor applied for an inquest under section 150. The trial court took the view that an inquest requires the physician to examine the body personally, that a physician who had merely confirmed the identity of the deceased with the inquiry official and looked at photographs and documents had not conducted one, and that the applicant therefore had no standing; it dismissed the petition. The Court of Appeal Region 9 dismissed the applicant's appeal as barred. The Supreme Court held that the applicant's appeal was in substance a complaint that the trial court's order did not comply with section 150 paragraph five, and not an appeal against an order made under that paragraph, so the order was not final under paragraph ten and the appeal was competent. It set aside the Court of Appeal's judgment and remitted the case for that court to hear and decide the appeal. The proposition that a valid inquest requires the physician to examine the body personally was the trial court's reasoning; the Supreme Court did not decide that question.

The inquiry and the order in an inquest are a special procedure that Section 150 paragraphs five and eleven require the court to take part in. A court of first instance may take part only where the case is within its jurisdiction, so where the person alleged to have caused the death must be prosecuted in the military court, the civil court cannot hold the inquest.
The prosecutor asked the civil court of first instance to inquire and make an order under Section 150 stating who had died, where, when and from what cause, the deceased having died while in the custody of officials. The Supreme Court held that court had no authority: the alleged offender was a conscript who had to be prosecuted in the military court under sections 13 and 16 (3) of the Military Court Organisation Act B.E. 2498, and a civil court may hold an inquest only in a case within its own jurisdiction.

A police officer who travels to give evidence to a court at an inquest into a death, in answer to the court's witness summons, is acting in the performance of his official duty. Under the Liability for Wrongful Acts of Officials Act B.E. 2539 an official is personally liable for a wrongful act in the performance of duty only where he acted intentionally for his own ends, intentionally to cause damage, or with gross negligence.
A police sergeant of the defendant state agency caused a traffic accident while travelling to give evidence at a court's inquest into a death, under a witness summons. The Supreme Court held that travelling to give that evidence was an act in the performance of his official duty, and that his negligence was ordinary rather than gross, so he was not personally liable. The injured plaintiff could therefore sue the state agency under section 5 of the Liability for Wrongful Acts of Officials Act B.E. 2539.
