เมื่อเจ้าพนักงานสั่งผู้ที่มั่วสุมเพื่อกระทำความผิดตามมาตรา ๒๑๕ ให้เลิกไป ผู้ใดไม่เลิก ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]

Where an official orders persons assembled for the purpose of committing an offence under Section 215 to disperse, whoever does not disperse shall be liable to imprisonment not exceeding three years, or a fine not exceeding sixty thousand baht, or both.

This offence is triggered by the official's order, not by the assembly itself. Section 215 punishes the assembly of ten or more; Section 216 punishes remaining after being told to disperse. In practice the order and its communication are the contested facts, because a person who did not hear or understand the order cannot fail to comply with it. The penalty is up to three years, or a fine of up to 60,000 baht, or both.
