ผู้ใดมีไว้เพื่อนำออกใช้ซึ่งสิ่งใด ๆ อันตนได้มาโดยรู้ว่าเป็นของปลอมตามมาตรา ๒๔๐ หรือของแปลงตามมาตรา ๒๔๑ ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบห้าปี และปรับตั้งแต่สองหมื่นบาทถึงสามแสนบาท หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]

Whoever has in possession, in order to put into use, anything that person obtained knowing it to be counterfeit under Section 240 or altered under Section 241, shall be liable to imprisonment from one year to fifteen years and a fine from twenty thousand baht to three hundred thousand baht.

The elements are possession, the purpose of putting the thing into use, and knowledge at the time of acquisition that it was counterfeit under Section 240 or altered under Section 241. Knowledge at acquisition is what separates this from Section 245, where the person took the currency innocently and only learned the truth afterwards. The penalty here, one to fifteen years and a fine from 20,000 to 300,000 baht, is much heavier for that reason.

Whether the holder already knew the banknotes were counterfeit at the moment of receiving them is a material fact in a currency-passing case, and knowing possession supports conviction under Section 244.
The case concerned whether the defendant already knew the seized banknotes were counterfeit when he received them. The Court treated that knowledge as a material fact going to the heart of the charge, and the defendants were convicted under Section 244 in combination with Section 247 for foreign currency.
