Article 254: Misuse of a genuine state seal

ผู้ใดทำปลอมขึ้นซึ่งแสตมป์รัฐบาล ซึ่งใช้สำหรับการไปรษณีย์ การภาษีอากรหรือการเก็บค่าธรรมเนียม หรือแปลงแสตมป์รัฐบาลซึ่งใช้ในการเช่นว่านั้นให้ผิดไปจากเดิม เพื่อให้ผู้อื่นเชื่อว่ามีมูลค่าสูงกว่าจริง ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงเจ็ดปี และปรับตั้งแต่สองหมื่นบาทถึงหนึ่งแสนสี่หมื่นบาท หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๔ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]

ต่างจากความผิดฐานปลอมที่อยู่รายรอบ มาตรานี้ว่าด้วยดวงตราแท้จริงที่ถูกนำไปใช้โดยไม่มีอำนาจ องค์ประกอบความผิดคือ (1) ใช้ (2) พระราชลัญจกร ดวงตราแผ่นดิน หรือดวงตราหรือรอยตราแท้ของทบวงการเมือง หน่วยงานของรัฐ หรือเจ้าพนักงาน (3) โดยมิชอบ คือไม่มีสิทธิหรืออำนาจที่จะใช้ บทนี้อุดช่องว่างที่มาตรา 250 ถึง 253 ทิ้งไว้ ซึ่งต้องเป็นดวงตราปลอม โดยเอาผิดผู้ที่นำดวงตราแท้ไปใช้โดยมิชอบ เช่น เจ้าพนักงานหรือคนในที่นำดวงตราแท้ไปประทับรับรองเอกสารที่ไม่ควรรับรอง โทษเบากว่าการปลอมเพราะดวงตรานั้นเป็นของแท้
