ถ้าผู้ต้องโทษกักขังถูกกักขังในที่อาศัยของผู้นั้นเอง หรือของผู้อื่นที่ยินยอมรับผู้นั้นไว้ ผู้ต้องโทษกักขังนั้นมีสิทธิที่จะดำเนินการในวิชาชีพหรืออาชีพของตนในสถานที่ดังกล่าวได้ ในการนี้ ศาลจะกำหนดเงื่อนไขให้ผู้ต้องโทษกักขังปฏิบัติอย่างหนึ่งอย่างใดหรือไม่ก็ได้ แล้วแต่ศาลจะเห็นสมควร

If a person sentenced to confinement is confined in that person's own residence, or in the residence of another person who consents to receive that person, the person confined has the right to carry on that person's profession or occupation at that place. In this regard the court may or may not fix any condition for the person confined to comply with, as the court thinks fit.

L'article 26 complète l'option de l'assignation à résidence prévue à l'article 24 en préservant les moyens de subsistance de la personne : une personne assignée à résidence peut poursuivre son activité professionnelle. Ceci reflète le caractère réhabilitatif et peu perturbateur de l'assignation à résidence, alternative moins contraignante à l'emprisonnement. Le pouvoir du tribunal d'imposer des conditions aux actes ou activités autorisés lui permet d'adapter l'ordonnance, autorisant le travail normal tout en restreignant les comportements liés à l'infraction ou susceptibles de faciliter une évasion ou la récidive. Il s'articule avec les articles 23, 24, 25 et 27 dans le cadre de la mise en œuvre de l'assignation à résidence.
Pourquoi cela est important en pratique
Pour un prévenu pouvant bénéficier d'une assignation à résidence, cette disposition protège ses revenus : il peut continuer à exercer son emploi ou son activité professionnelle pendant sa peine, sous réserve des conditions fixées par le tribunal. Lors d'une demande d'assignation à résidence en vertu de l'article 24, il est utile de présenter au tribunal un plan réaliste permettant de poursuivre une activité professionnelle légale dans des conditions compatibles avec la réalité. L'assignation à résidence peut ainsi s'avérer bien moins préjudiciable qu'une courte peine d'emprisonnement.
