Section 269/5 addresses a different wrong from the forging offences that precede it: the unauthorised use of a genuine electronic card belonging to another person. The elements are: (1) using the electronic card of another; (2) unlawfully, meaning without right or authority; and (3) a manner likely to cause damage to another person or to the public. No forged card is required. Because Section 1(14) defines an electronic card to include data, codes, and account numbers issued without any physical card, this Section reaches the unauthorised use of card numbers and online credentials, not only the physical plastic. The offence is drafted with a maximum only and no minimum, and the penalty is alternative, so a fine only sentence is available. Section 269/6 punishes possessing another person's card in order to put it into use, and Section 269/7 increases the penalty by one half where the card is a payment or cash withdrawal card, which is the ordinary case.
Why this matters in practice
This is the everyday offence for using a lost, stolen, found, or borrowed card without authority, and it is the provision most likely to affect an ordinary person rather than an organised fraud ring. Its practical bite is that repeated use multiplies liability: each transaction at a different time and for a different amount can be charged as a separate count. Two situations recur in practice. A spouse, employee, or family member who uses a card they were permitted to hold but not to use for that purpose is within the wording, because the authority is to hold, not to spend. And a person who uses a card belonging to someone who has died is not acting with authority, because the mandate ends at death. Charges under this Section are routinely accompanied by theft under Sections 334 and 335 for the money or goods obtained.
