Whoever possesses, in order to put into use, the electronic card of another person unlawfully under Section 269/5, in a manner likely to cause damage to another person or to the public, shall be liable to imprisonment not exceeding three years, or a fine not exceeding sixty thousand baht, or both.

Section 269/6 is the inchoate form of Section 269/5. It criminalises possession of another person's electronic card where the possession is for the purpose of putting the card into use unlawfully within the meaning of Section 269/5, and where that is likely to cause damage. The provision expressly incorporates Section 269/5, so the intended use must be an unlawful one; possession alone, without that purpose, is not caught by this Section, although it may amount to theft or misappropriation of the card as a physical object. The penalty is lower than for the completed use, three years against five, which is the ordinary structure of preparatory liability. Section 269/7 applies here as well, raising the maximum to four years and six months where the card is a payment or cash withdrawal card.
Why this matters in practice
In practice this Section is what allows a charge where a defendant is found holding cards belonging to other people but no transaction can be proved, for example cards recovered during a search. Because purpose is the operative element and possession is usually admitted, the defence is directed at why the cards were held. Note the distinction that matters at charging stage: this Section concerns genuine cards belonging to others, while Section 269/4 concerns forged cards. A defendant found with a mixture of both will face counts under each.

Oui.
