ในกรณีที่ศาลพิพากษาปรับ ผู้ต้องโทษปรับซึ่งมิใช่นิติบุคคลและไม่มีเงินชำระค่าปรับอาจยื่นคำร้องต่อศาลชั้นต้นที่พิพากษาคดีเพื่อขอทำงานบริการสังคมหรือทำงานสาธารณประโยชน์แทนค่าปรับ หรือถ้าความปรากฏแก่ศาลในขณะที่พิพากษาคดีว่าผู้ต้องโทษปรับรายใดอยู่ในเกณฑ์ที่จะทำงานบริการสังคมหรือทำงานสาธารณประโยชน์ตามมาตรานี้ได้ และถ้าผู้ต้องโทษปรับยินยอม ศาลจะมีคำสั่งให้ผู้นั้นทำงานบริการสังคมหรือทำงานสาธารณประโยชน์แทนค่าปรับก็ได้[๒๔] การพิจารณาคำร้องตามวรรคแรก เมื่อศาลได้พิจารณาถึงฐานะการเงิน ประวัติและสภาพความผิดของผู้ต้องโทษปรับแล้ว เห็นเป็นการสมควร ศาลจะมีคำสั่งให้ผู้นั้นทำงานบริการสังคมหรือทำงานสาธารณประโยชน์แทนค่าปรับก็ได้ ทั้งนี้ ภายใต้การดูแลของพนักงานคุมประพฤติ เจ้าหน้าที่ของรัฐ หน่วยงานของรัฐ หรือองค์การซึ่งมีวัตถุประสงค์เพื่อการบริการสังคม การกุศลสาธารณะหรือสาธารณประโยชน์ที่ยินยอมรับดูแล กรณีที่ศาลมีคำสั่งให้ผู้ต้องโทษปรับทำงานบริการสังคมหรือทำงานสาธารณประโยชน์แทนค่าปรับ ให้ศาลกำหนดลักษณะหรือประเภทของงาน ผู้ดูแลการทำงาน วันเริ่มทำงาน ระยะเวลาทำงาน และจำนวนชั่วโมงที่ถือเป็นการทำงานหนึ่งวัน ทั้งนี้ โดยคำนึงถึงเพศ อายุ ประวัติ การนับถือศาสนา ความประพฤติ สติปัญญา การศึกษาอบรม สุขภาพ ภาวะแห่งจิต นิสัย อาชีพ สิ่งแวดล้อมหรือสภาพความผิดของผู้ต้องโทษปรับประกอบด้วย และศาลจะกำหนดเงื่อนไขอย่างหนึ่งอย่างใดให้ผู้ต้องโทษปรับปฏิบัติเพื่อแก้ไขฟื้นฟูหรือป้องกันมิให้ผู้นั้นกระทำความผิดขึ้นอีกก็ได้ ถ้าภายหลังความปรากฏแก่ศาลว่าพฤติการณ์เกี่ยวกับการทำงานบริการสังคมหรือทำงานสาธารณประโยชน์ของผู้ต้องโทษปรับได้เปลี่ยนแปลงไป ศาลอาจแก้ไขเปลี่ยนแปลงคำสั่งที่กำหนดไว้นั้นก็ได้ตามที่เห็นสมควร ในการกำหนดระยะเวลาทำงานแทนค่าปรับตามวรรคสาม ให้นำบทบัญญัติมาตรา ๓๐ มาใช้บังคับโดยอนุโลม และในกรณีที่ศาลมิได้กำหนดให้ผู้ต้องโทษปรับทำงานติดต่อกันไป การทำงานดังกล่าวต้องอยู่ภายในกำหนดระยะเวลาสองปีนับแต่วันเริ่มทำงานตามที่ศาลกำหนด เพื่อประโยชน์ในการกำหนดจำนวนชั่วโมงทำงานตามวรรคสาม ให้ประธานศาลฎีกามีอำนาจออกระเบียบราชการฝ่ายตุลาการศาลยุติธรรมกำหนดจำนวนชั่วโมงที่ถือเป็นการทำงานหนึ่งวัน สำหรับงานบริการสังคมหรืองานสาธารณประโยชน์แต่ละประเภทได้ตามที่เห็นสมควร

English translation

Where the court imposes a fine, a person sentenced to the fine who is not a juristic person and who has no money to pay it may file a motion with the court of first instance that gave judgment, asking to perform social service work or work for the public benefit in place of the fine. Alternatively, if it appears to the court at the time of giving judgment that a person sentenced to a fine falls within the criteria for performing such work under this Section, and if that person consents, the court may order that person to perform social service work or work for the public benefit in place of the fine.
In considering a motion under paragraph one, when the court has considered the financial position, the personal history, and the nature of the offence of the person sentenced to the fine and thinks it appropriate, the court may order that person to perform social service work or work for the public benefit in place of the fine, under the supervision of a probation officer, a State official, a State agency, or an organisation whose object is social service, public charity, or the public benefit and which consents to supervise.
Where the court orders a person sentenced to a fine to perform such work, the court shall fix the nature or type of work, the person supervising it, the day on which it is to begin, the period of the work, and the number of hours to be counted as one day's work, having regard also to the sex, age, personal history, religion, conduct, intelligence, education and training, health, mental condition, disposition, occupation, environment, or the nature of the offence of that person; and the court may fix any condition for that person to comply with in order to correct or rehabilitate that person, or to prevent that person from committing an offence again.
If it later appears to the court that the circumstances relating to that person's social service work or work for the public benefit have changed, the court may amend or vary the order it has made as it thinks fit.
In fixing the period of work in place of the fine under paragraph three, the provisions of Section 30 shall apply mutatis mutandis; and where the court has not ordered the person to work continuously, the work must be completed within two years from the day on which it begins as fixed by the court.
For the purpose of fixing the number of hours of work under paragraph three, the President of the Supreme Court has the power to issue a regulation of the judicial service of the Courts of Justice fixing the number of hours to be counted as one day's work for each type of social service work or work for the public benefit, as the President thinks fit.

It is an alternative to detention in lieu of an unpaid fine under Sections 29 and 30: instead of being detained, a natural person of limited means may work the fine off. There are two routes into it, and only the first is a motion. A person sentenced to a fine who is not a juristic person and has no money to pay may file a motion with the court of first instance that gave judgment; alternatively, if it appears to that court at the time of giving judgment that the person falls within the criteria of this Section, the court may order the work of its own motion, provided the person consents. On a motion the court considers the person's financial position, personal history and the nature of the offence. Where the work is ordered the court must fix the nature or type of work, the person supervising it, the starting day, the period, and the number of hours counted as one day's work, and may attach conditions. The rate at which work is credited against the fine comes from applying Section 30 mutatis mutandis, that is five hundred baht per day; and where the court has not ordered continuous work it must be completed within two years from the starting day. Sections 30/2 and 30/3 complete the scheme, governing revocation or change of the permission and the finality of the court's order.

Why this matters in practice

If you are fined and genuinely cannot pay, this route avoids detention in lieu of the fine. You can petition the same trial court that gave judgment, and that court can also order the work at the time of judgment if you consent, so it is worth raising before judgment as well as after. Work is credited at five hundred baht a day, the same rate as detention in lieu of a fine, and where the court does not order continuous work it must be finished within two years of the starting day it fixes. The permission is conditional: under Section 30/2 the court can revoke it and impose the fine or detention in lieu of it if you had enough money to pay when you filed the motion, or if you violate or fail to comply with an order or condition, deducting the days already worked from the fine. The same section lets you give the work up voluntarily and change to paying the fine or to detention, again with credit for the days worked. Orders under Sections 30/1 and 30/2 are final under Section 30/3. Only natural persons qualify, so a company fined for an offence cannot use it (see corporate criminal liability in Thailand).

    In a joint assault and firearm-imitation case, the court noted that in ordering how an unpaid fine was to be enforced, Section 30/1 should not have been listed, since that provision applies only when the convicted person petitions to perform community service in lieu of the fine.
