Thai labour law protects the employee, and most disputes are lost by employers on paperwork: a probation that ran one day too long, a notice counted as “30 days”, a dismissal letter that does not state its reason. This pack gives a small employer seven documents: the six used from the first day of work to the last, and an employer guide with plain instructions on when to use each one and how to fill it in. It is made for the usual case: an adult employee, paid by the month, hired for an indefinite period by a private business.
1. The Employment Agreement
Word file to fill in on your computer and PDF to fill in by hand, 18 pages, English and Thai clause by clause, with initials boxes on every page, a signature page for the employer, the employee and two witnesses, and three schedules.
- Position, duties, start date and probation of up to 119 days
- Place of work, working hours, rest period and weekly holiday
- Wages, pay day, lawful deductions, overtime and holiday work at the legal rates
- Public holidays, annual leave, sick leave, personal business leave, maternity leave of 120 days and spouse leave
- Social Security, income tax, Employee Welfare Fund or provident fund
- Work rules, conduct and written warnings
- Confidentiality, intellectual property and personal data
- Optional non-competition and non-solicitation clause (tick box)
- Notice from pay day to pay day, pay in place of notice, the severance pay ladder and retirement
- The six grounds for dismissal without notice and without severance pay, and an agreed list of serious cases
- Return of property, final payment and certificate of employment
- Clause for a foreign employee (work permit and visa)

2. The Letters and Forms
One Word file and one PDF, 11 pages, English and Thai, five documents, each starting on a new page with its own page numbers. They are clean letters that you can hand to the employee: all the guidance for the employer is in the Instructions.
- Written Warning, with the record of delivery if the employee does not sign
- Letter of Termination with notice or pay in place of notice, and severance pay
- Letter of Termination for Serious Cause, with the six grounds of section 119 as tick boxes
- Final Payment Statement and Receipt, with an optional release
- Certificate of Employment
3. The Instructions
PDF, 22 pages, complete English text then complete Thai text, so that the employer and the Thai staff or accountant read the same thing.

Owners and managers of small businesses in Thailand, Thai or foreign, who employ staff directly and want correct bilingual paperwork. It is not made for fixed term project or seasonal jobs, employees under 18, domestic or farm work, staff paid by the day or by the piece, or job cuts caused by a move of the workplace or by new technology. It does not contain work rules, which are compulsory from 10 employees.
