Section 1413 makes superficies more valuable than usufruit or habitation: it can be sold, mortgaged (with consent of landowner), and inherited. The deed can restrict transfer, but absent restriction, the superficies is a tradeable asset. For estate-planning purposes, this means a foreign client's house (held under registered superficies) can be devised by will to children, unlike a usufruct, which would extinguish at the client's death.
