สิทธิในการไถ่ทรัพย์สินนั้น จะพึงใช้ได้แต่บุคคลเหล่านี้ คือ(๑) ผู้ขายเดิม หรือทายาทของผู้ขายเดิม หรือ(๒) ผู้รับโอนสิทธินั้น หรือ(๓) บุคคลซึ่งในสัญญายอมไว้โดยเฉพาะว่าให้เป็นผู้ไถ่ได้
