Article 21 — Applications, motions and the right to be heard

เมื่อคู่ความฝ่ายใดเสนอคำขอหรือคำแถลงต่อศาล
(๑) ถ้าประมวลกฎหมายนี้มิได้บัญญัติว่า คำขอหรือคำแถลงจะต้องทำเป็นคำร้องหรือเป็นหนังสือ ก็ให้ศาลมีอำนาจที่จะยอมรับคำขอหรือคำแถลงที่คู่ความได้ทำในศาลด้วยวาจาได้ แต่ศาลต้องจดข้อความนั้นลงไว้ในรายงาน หรือจะกำหนดให้คู่ความฝ่ายนั้นยื่นคำขอโดยทำเป็นคำร้องหรือยื่นคำแถลงเป็นหนังสือก็ได้ แล้วแต่ศาลจะเห็นสมควร
(๒) ถ้าประมวลกฎหมายนี้มิได้บัญญัติไว้ว่า คำขออันใดจะทำได้แต่ฝ่ายเดียว ห้ามมิให้ศาลทำคำสั่งในเรื่องนั้น ๆ โดยมิให้คู่ความอีกฝ่ายหนึ่งหรือคู่ความอื่น ๆ มีโอกาสคัดค้านก่อน แต่ทั้งนี้ ต้องอยู่ในบังคับแห่งบทบัญญัติของประมวลกฎหมายนี้ว่าด้วยการขาดนัด
(๓) ถ้าประมวลกฎหมายนี้บัญญัติไว้ว่า คำขออันใดอาจทำได้แต่ฝ่ายเดียวแล้ว ให้ศาลมีอำนาจที่จะฟังคู่ความอีกฝ่ายหนึ่งหรือคู่ความอื่น ๆ ก่อนออกคำสั่งในเรื่องนั้น ๆ ได้ เว้นแต่ในกรณีที่คำขอนั้นเป็นเรื่องขอหมายเรียกให้ให้การ หรือเพื่อยึดหรืออายัดทรัพย์สินก่อนคำพิพากษา หรือเพื่อให้ออกหมายบังคับ หรือเพื่อจับหรือกักขังจำเลยหรือลูกหนี้ตามคำพิพากษา
(๔) ถ้าประมวลกฎหมายนี้มิได้บัญญัติไว้ว่าศาลต้องออกคำสั่งอนุญาตตามคำขอที่ได้เสนอต่อศาลนั้นโดยไม่ต้องทำการไต่สวนแล้ว ก็ให้ศาลมีอำนาจทำการไต่สวนได้ตามที่เห็นสมควรก่อนมีคำสั่งตามคำขอนั้นในกรณีเรื่องใดที่ศาลอาจออกคำสั่งได้เองหรือต่อเมื่อคู่ความมีคำขอ ให้ใช้บทบัญญัติอนุมาตรา
(๒),
(๓) และ
(๔) แห่งมาตรานี้บังคับในกรณีเรื่องใดที่คู่ความไม่มีอำนาจขอให้ศาลมีคำสั่ง แต่หากศาลอาจมีคำสั่งในกรณีเรื่องนั้นได้เอง ให้ศาลมีอำนาจภายในบังคับบทบัญญัติแห่งมาตรา ๑๐๓ และ ๑๘๑
(๒) ที่จะงดฟังคู่ความหรืองดทำการไต่สวนก่อนออกคำสั่งได้

When any party submits an application or a statement to the court:
(1) if this Code does not provide that the application or statement must be made in the form of a motion or in writing, the court has the power to accept the application or statement that the party has made orally in court, but the court must record such content in the report; or the court may require that party to submit the application in the form of a motion, or to submit the statement in writing, as the court thinks fit;
(2) if this Code does not provide that any application may be made ex parte, the court is prohibited from making an order in such matter without first giving the other party or other parties an opportunity to object; but this is subject to the provisions of this Code concerning default;
(3) if this Code provides that any application may be made ex parte, the court has the power to hear the other party or other parties before making its order in such matter, except in the case where the application is a matter of requesting a summons to file a defence, or to seize or attach property before judgment, or to have a writ of execution issued, or to arrest or detain the defendant or the judgment debtor;
(4) if this Code does not provide that the court must make an order granting an application submitted to it without holding an inquiry, the court has the power to hold an inquiry as it thinks fit before making its order on that application.
In any matter in which the court may make an order of its own motion, or only upon the application of a party, the provisions of sub-sections (2), (3) and (4) of this section shall apply. In any matter in which a party has no power to apply for a court order, but in which the court may make an order in that matter of its own motion, the court shall have the power, subject to sections 103 and 181(2), to dispense with hearing the parties or with holding an inquiry before making its order.

Section 21 is a general procedural provision in Chapter 3 that governs the form of applications and the audi alteram partem principle. Sub-section (1) permits oral applications where no written form is required, subject to recording; sub-section (2) states the default rule that no order may be made on an application without hearing the opposing party, subject only to the default rules. Sub-section (3) governs genuinely ex parte applications, allowing but not requiring the court to hear the other side, except in listed urgent matters such as pre-judgment seizure or attachment, issue of a writ of execution, or arrest of a defendant or judgment debtor, where the element of surprise is essential. Sub-section (4) preserves the court's discretion to hold an inquiry before ruling. The closing paragraphs extend (2), (3) and (4) to matters the court may raise of its own motion and, for matters solely within the court's own initiative, allow it to dispense with hearing or inquiry, subject to Sections 103 and 181(2).

The practical lesson is that in most situations the other side is entitled to object before the court rules, so you should expect to serve your motion and give them that chance; skipping it can get the resulting order set aside. The narrow exceptions are the urgent, surprise measures like pre-judgment attachment or a writ of execution, where an application can be made ex parte. Knowing which category your application falls into shapes how and when you file it, and getting it wrong can waste a hearing; when in doubt, take conseils juridiques on the correct procedure.

  1. Supreme Court Judgment No. 2674/2565 (2022)

    A motion asking the court to treat its judgment as substituting the judgment debtor's declaration of intent under Section 357 is not one the Code allows to be made ex parte, so under Section 21(2) the court may not rule on it without first giving the other party an opportunity to object.

    The judgment creditors moved to have the court's judgment treated as substituting the judgment debtors' declaration of intent under Section 357. The Supreme Court held such a motion is not one the Code permits to be made ex parte, so Section 21(2) barred the court from ruling without giving the other side a chance to object.

  2. Supreme Court Judgment No. 2280/2559 (2016)

    Under Section 21(4), if the court considers the facts of the case sufficient to decide an application, it need not hold an inquiry before ruling on it.

    On a motion to stay execution, the court held that where the facts on the record are sufficient to decide the motion, it need not hold an inquiry, applying Section 26 of the Intellectual Property and International Trade Court Act together with Section 21(4). The discretion to dispense with an inquiry rests with the court once the facts are adequate.

  3. Supreme Court Judgment No. 2742/2559 (2016)

    Where a motion is not one the Code allows to be made ex parte under Section 21(2), proceeding and ruling on it without serving a copy on the other parties is improper, and the defect concerns public order so a higher court may raise it of its own motion.

    The trial court ordered on the applicant's motion without serving a copy on the plaintiff and the second defendant, although the motion was not one that could be made ex parte under Section 21(2). The Supreme Court held that proceeding and ruling this way was improper, and that because the defect concerned public order it could raise the point of its own motion under Section 142(5).

Can the court rule on a motion without hearing the other side?

Usually no. Section 21(2) bars the court from making an order on an application without first giving the other party a chance to object, unless the Code allows that application to be made ex parte.

Which applications can be made ex parte?

Those the Code allows, and Section 21(3) specifically lists urgent measures such as pre-judgment seizure or attachment, issuing a writ of execution, and arrest or detention of a defendant or judgment debtor.

Must an application always be in writing?
